NOTICE is hereby given, in accordance with the provisions of the Rules Publication Act, 1893, that the Irish Land Commission propose to make the Rules set out in the Schedule hereto, the same having, by order of the said Commission, bearing date the 18th day of September, 1923, been made to come into immediate operation as Provisional Rules, and to continue in force until Rules shall have been made in accordance with the provisions of the Rules Publication Act.

And Notice is hereby given, that copies of such Rules, as Draft Rules under the same Act, may be purchased from Messrs Eason and Son, 40 and 41 Lower O'Connell Street, Dublin.

PROVISIONAL RULES UNDER THE LAND ACT, 1923.

The Irish Land Commission, after consultation with the President of the Incorporated Law Society of Ireland, hereby certify that for the purpose of bringing the Land Act, 1923 , into operation it is necessary that the Rules set forth in the Schedule hereto should come into immediate operation and accordingly hereby Order pursuant to the power in that behalf conferred by section two of the Rules Publication Act, 1893, and all other powers them thereunto enabling that such Rules come into operation forthwith as Provisional Rules and continue in force until Rules shall have been made in accordance with the provisions of the Rules Publication Act.

THE SCHEDULE REFERRED TO

RULES UNDER THE LAND ACT, 1923 .

The 18th day of September, 1923.

In pursuance of the provisions of Section 76 of the Land Act, 1923 , the Land Commission, after consultation with the President of the Incorporated Law Society of Ireland, hereby Order that the following rules shall from and after this date and until further Order be in force in relation to all proceedings for the purpose of carrying into effect the provisions of the said Act.

These Rules are in addition to the Provisional Rules made on the 18th day of August, 1923.

COMPOUNDED ARREARS OF RENT AND PAYMENT IN LIEU OF RENT.

1. Any land-agent, solicitor, or land-clerk nominated by the immediate landlord, or, in default of such nomination, selected by the Land Commission and employed in the collection of compounded arrears of rent or payment in lieu of rent shall be paid by the Land Commission such percentage on the amount collected in each case as may be agreed upon between the landlord and such person or in default of agreement fixed by the Judicial Commissioner. The amount so paid shall be deducted from the payments made by the Land Commission in respect of compounded arrears of rent or payment in lieu of rent.

This remuneration shall cover work done by the person so employed in furnishing the particulars required by the Land Commission for the purpose of the collection of compounded arrears of rent and payment in lieu of rent, the distribution to the tenants concerned of the Receivable Orders issued by the Land Commission and such other work as may be directed by them. In fixing the percentage regard shall be had to the amount and nature of the work done and to any payments already received by such person from the landlord on account of such work.

In any case where legal proceedings have been taken by the Land Commission in order to recover compounded arrears of rent or payment in lieu of rent then, notwithstanding any agreement as aforesaid, the percentage shall be such sum as shall be fixed by the Judicial Commissioner.

ASCERTAINMENT OF LANDS TO BE VESTED IN THE LAND COMMISSION.

2. The application for particulars required for the ascertainment of lands to be vested in the Land Commission shall be served on the person or persons from whom such particulars are required by delivery of the same personally, or by registered post, addressed to such person or persons where known and available or, where not known or available, to his or their known Solicitor or agent at his or their usual or last known place of abode or business.

3. The particulars required from a person entitled to the rents and profits of any land shall be furnished by him or by his Solicitor or agent on his behalf in the Forms A, B, C, D, E and F, in the Appendix hereto, within three months from the date of the service of the application and shall be verified by affidavit.

4. With the particulars furnished in accordance with the preceding rule there shall be lodged a Map or Maps of the lands set out in Forms A, B, C, D and E, drawn upon the latest edition of an Ordnance Map on the six-inch scale, neatly mounted on strong linen. Each Map shall not ordinarily be less than 12 inches by 12 inches in size, and, save, for special reasons, shall not exceed 24 inches by 18 inches.

5. Upon every Map lodged with particulars the boundaries shall be neatly and clearly indicated in waterproof colours as follows :—

(a) The external boundary of the owner's estate (or of groups of townlands if more than one Map be lodged) to be a broad edging of carmine or vermilion. Townland boundaries within the estate to be shown by a similar, but narrower, edging of the same colour.

(b) The holdings to be outlined in green. Portions of holdings sub-let to be shown by a complete colour-wash of pale green.

(c) Untenanted land other than Demesnes to be edged yellow.

(d) Demesne to be edged blue.

(e) Small areas such as labourers' plots, within the external boundary but not part of the Owner's estate, to be shown by a complete colour-wash of carmine or vermilion. Larger areas to be edged as for an external boundary and marked " Excluded."

(f) Fisheries to be shown by a complete colour wash of brown.

The colours, while distinctive and permanent, should not be so dark as to unnecessarily obscure the features of the Ordnance Sheet.

6. Where the holdings, plots or parcels of land, in whole or part, are so small or so intermixed that they cannot be clearly and accurately indicated on the six-inch scale, enlargements on the sale of ½500, 5 feet or 10 feet shall be made, or an Ordnance Map on a larger scale than the 6 inch shall be used.

7. The Map or Maps shall be accompanied by :—

(a) A schedule of areas in the Form G in the Appendix hereto, in which shall be shown the area of each plot or parcel of land bearing a separate map number, as well as the total area of each holding, the total area of Untenanted land other than Demesne, the total area of Demesne and the total area of all the lands set out in Forms A, B, C, D and E. The figures in the Schedule should be totalled by townlands separately, closed to the townland area and summarised at end, and

(b) An affidavit in the Form H in the Appendix hereto, by a Surveyor or other person competent to make a Map of the lands according to these rules and to verify the Schedule of Areas.

8. The particulars with the Map, Schedule of Areas and verifying affidavits shall be lodged in the Purchase Branch of the Land Commission and when certified by the proper officer to be prima facie suitable and correct shall be marked with a Record Number and the lands comprised therein shall be dealt with as far as possible in accordance with their priority on the record.

9. Copies of the Iris Oifigiúil containing Provisional Lists of lands which will become vested in the Land Commission on the appointed day shall be filed in the Purchase Branch of the Land Commission and shall be open to inspection by all persons during office hours.

The Land Commission shall transmit by post a copy of the list together with a notice stating the manner in which and the time within which objections to the same by reason of the inclusion or non-inclusion therein of any land may be made to such persons as appear to them to be interested in the said lands.

10. An objection to a Provisional List shall be made in writing and lodged in the Purchase Branch of the Land Commission within two months of the date of the publication of the list in the Iris Oifigiúil. The statement of the objection shall set forth an accurate description of the lands to which it refers, the nature of the interest therein of the objector, and the reasons for his objection.

All objections shall be filed in the Purchase Branch of the Land Commission and shall be open to inspection during Office hours.

11. Objections shall be listed for hearing by the Land Commission on such dates as shall be convenient, and ten days' notice of the listing shall be served on the objector personally or by registered post and a copy of the objection and a notification of the date of hearing shall be served personally or by registered post on all persons who appear to the Land Commission to be interested in the objection.

12. Any person aggrieved by a decision of the Land Commission on the hearing of an objection who desires to appeal therefrom shall, within 14 days from the date of such decision, serve notice of appeal to the Judicial Commissioner on the other interested parties, which notice may be in the Form J in the Appendix hereto, and within 10 days from the date of such service shall lodge with the Registrar of the Land Commission the original Notice of Appeal, which shall be endorsed with the time and mode of service on the interested parties. Such appeal may thereupon be listed for hearing at any time after the expiration of 14 days from the lodgment of such notice.

PRICE.

First Schedule : Part I.

13. An application by a landlord or tenant of a holding subject to a judicial rent fixed by agreement on the reinstatement therein of a tenant, who, or whose predecessor in title, had been evicted therefrom to have the standard purchase annuity fixed as if the rent were a non-judicial rent shall be made by Notice which may be in the Form K in the Appendix hereto.

The Notice shall be first served on the opposite party and forthwith after such service, or the last of such services if more than one, the Original Notice endorsed with the time and mode of service on the party or parties served shall be lodged in the Purchase Branch of the Land Commission.

The service of the Notice shall be made not later than two months after the publication of the Provisional List of lands about to be vested in the Land Commission containing the holding in question.

First Schedule : Part II

14. An agreement between a landlord and a tenant of a holding subject to a rent other than a judicial rent that the standard purchase annuity shall be the amount therein mentioned may be in the Form L in the Appendix hereto signed by the landlord and the tenant or their duly authorised agents and shall be lodged in the Purchase Branch of the Land Commission not later than two months after the publication of the Provisional List of lands about to be vested in the Land Commission containing the holding in question.

15. Where in default of agreement the standard purchase annuity in the case of a holding subject to a rent other than a judicial rent, or the price of untenanted land, is fixed by the Land Commission, Notice of the amount so fixed shall be published in the Iris Oifigiúil and shall be sent by registered post to the landlord and tenant of a holding or to the Owner of untenanted land as the case may be.

Section 25 (2).

16. Any person aggrieved by a decision of the Land Commission fixing the standard purchase annuity in the case of a holding or the price of untenanted land who desires to appeal therefrom shall within one month from the date of the publication of the Notice of such decision serve Notice of Appeal to the Judicial Commissioner which Notice may be in the Form M in the Appendix hereto and shall be lodged with the Registrar of the Land Commission. In the case of a holding the Notice shall be first served on the opposite party (landlord or tenant as the case may be) and the Notice lodged with the Registrar of the Land Commission shall be endorsed with the time and mode of such service. Such Appeal may thereupon be listed for hearing at any time after the expiration of 14 days from the lodgment of such Notice.

RETAINED HOLDINGS.

Section 28 (6).

17. The Land Commission shall publish from time to time in the Iris Oifigiúil lists of holdings retained under sub-heads (a), (b), (c) and (d) of sub-section (6) of Section 28 of the Act.

Copies of the Iris Oifigiúil containing lists of retained holdings shall be filed in the Purchase Branch of the Land Commission and shall be open to inspection by all persons during Office hours.

The Land Commission shall serve the person appearing to be in occupation as tenant of a retained holding, either personally or by registered post, with a Notice containing a description of the holding and the reasons for retention.

Section 28 (6).

18. Any objection by a person in occupation of a holding included in a list of holdings retained by the Land Commission that the holding should not have been so included shall be in writing setting forth the grounds of objection and lodged in the Purchase Branch of the Land Commission within one month of the date of the service of the Notice aforesaid.

The objection shall be listed for hearing by the Land Commission on such date as shall be convenient and 10 days' notice of the listing shall be served on the objector personally or by registered post.

Section 33.

19. An application by a person in occupation as tenant of a retained holding to be allowed to purchase from the Land Commission the holding, or such part of the holding as has not been resumed, at the standard price, or the proportionate part of the standard price applicable to the part not resumed, may be in the Form N in the Appendix hereto and shall be lodged in the Purchase Branch of the Land Commission not later than one month after the date of the Order authorising resumption.

Section 34.

20. An Offer by the Land Commission to the tenant of a retained holding to sell to him the holding, or a new holding consisting of part of the original holding, or of the whole or part of the original holding and other land, shall be in the Form O in the Appendix hereto with such variations as the nature of the case may require

The Offer accompanied in the case of a new holding by a Map of the lands set out therein shall be served on the said tenant personally or by registered post and may be accepted within one month from the date of the service thereof. If not so accepted the tenant shall be deemed to have refused the offer.

Section 34 (1)

21. Notice to a tenant of a retained holding, who has refused an offer of the Land Commission to sell to him the holding or a new holding, that the Land Commission intend to make an Order declaring him to be the purchaser of such holding shall be in the Form P in the Appendix hereto with such variations as the nature of the case may require and shall be served on the tenant personally or by registered post.

Section 34 (1).

22. An objection by a tenant of a retained holding to the Land Commission making an Order declaring him to be the purchaser of the holding or of a new holding shall be made in writing and lodged in the Purchase Branch of the Land Commission within one month of the date of the service of the notice of intention to make such Order.

The objection shall be listed for hearing by the Land Commission on such date as shall be convenient and 10 days' notice of the listing shall be served on the objector personally or by registered post.

Section 34 (2).

23. Any tenant of a retained holding aggrieved by an Order of the Land Commission declaring him to be the purchaser of the holding or of a new holding who desires to appeal therefrom shall within 21 days from the date of such Order serve Notice of Appeal to the Judicial Commissioner which Notice may be in the Form Q in the Appendix hereto and shall be lodged with the Registrar of the Land Commission.

Such appeal may thereupon be listed for hearing at any time after the expiration of 14 days from the lodgment of such Notice.

RESALE OF UNTENANTED LAND TO OWNERS.

Section 32.

24. An application by an Owner of a parcel of untenanted land to repurchase the same or part thereof may be in the Form R in the Appendix hereto and shall be lodged in the Purchase Branch of the Land Commission at any time after the publication of the Provisional List of lands about to be vested in the Land Commission containing the parcel in question and before the Appointed Day.

POWERS TO PROVIDE RIGHTS OF WAY.

Section 43.

25. A Notice of the intention of the Land Commission to provide a right of way to and from any land and of the compensation (if any) to be paid to the owner of the land over which such right of way is to be conferred or defined shall be served on the said owner personally or by registered post and shall have annexed thereto a map showing the right of way.

26. An abjection by an owner of land over which a right of way is intended to be conferred or defined shall be made in writing stating the grounds of his objection and lodged in the Purchase Branch of the Land Commission within one month of the date of the service of the Notice of intention to provide such right of way.

The objection shall be listed for hearing by the Land Commission on such date as shall be convenient and 10 days' notice of the listing shall be served on the objector and all persons who appear to the Land Commission to be interested in the objection personally or by registered post.

On the hearing of such objection or, if no objection has been taken, after the time for lodging an objection has expired the Land Commission may make an Order in the terms set out in the Notice with such variations as, after the hearing, may seem to them fit.

GENERAL.

Section 67.

27. An application to nominate a person to represent a tenant for the purpose of the sale of a holding in respect of which a purchase agreement has been entered into or is deemed to have been entered into by the tenant shall be made to the Land Commission (other than the Judicial Commissioner) and shall be supported by an affidavit proving the death or absence of the tenant as the case may be and all other relevant facts and giving the names and addresses, so far as known, of all persons interested in the tenant's holding and evidence of the fitness of the person proposed to be nominated as representative and of his consent so to act.

Where no application is made by any person to be nominated as aforesaid the Land Commission after notifying such persons as appear to them to be interested in the holding of the tenant and after hearing such objections as may be received or if no objections have been received then within 14 days after such notice has been issued may nominate such person as they think fit to represent such deceased or absent tenant for the purposes aforesaid.

28. The Land Commission (including the Judicial Commissioner) shall have power to enlarge or abridge the time appointed by these Rules for doing any act or taking any proceedings upon such terms, if any, as the justice of the case may require and any such enlargement may be applied for and ordered after the expiration of the time appointed or allowed.

29. Such of the Rules of the Land Commission (including Rules made by the Estates Commissioners) under the Land Purchase Acts as are expressly or by manifest implication applicable to proceedings under the Land Act 1923 shall, where the context thereof so permits but so far only as consistent with these Rules, apply to such proceedings.

COPIES of the Forms A, B, C, D and E prescribed by the Rules dated 18th September, 1923, under the above Act can be obtained on application to the Land Commission Offices, 24, Upper Merrionstreet, Dublin.

When applying for the Forms the name of the Owner of the Estate, the County in which the lands are situate, and the approximate number of tenants holding under (a) judicial rents fixed before 16th August, 1911 ; (b) judicial rents fixed after 15th August, 1911 ; and (c) rents other than judicial rents, should be given.
