20/04/1923: Registration of Electors (Defence Force) Order, 1923.

WHEREAS by Section 61 of the Electoral Act, 1923 (hereinafter referred to as "the Act"), the Franchise Resolutions adopted by the Provisional Parliament on the 19th day of September were confirmed; and the register in course of preparation under the said Resolutions was directed to be completed in accordance with the said Resolutions, save that the provisions of the Act relating among other things to the registration of and voting by members of the Defence Force of Saorstát Eireann and voting by post should apply to the aforesaid register:

And whereas it is enacted by sub-section (1) of Section 62 of the Act that if any difficulty shall arise in the preparation of the said register under the said Section 61 and the said Resolutions, the Minister for Local Government may by order do any matter or thing which appears to him necessary for the proper preparation of such register:

And whereas a difficulty has arisen in respect of the application to the said register of the said provisions of the Act, and it appears to Me necessary for the proper preparation of the aforesaid register to provide as hereinafter appearing:

Now, therefore, I, the Minister for Local Govenment, do hereby order as follows in respect of the preparation of the said register:—

1. A certificate of the Minister for Defence that a person is serving as a member of the Defence Force of Saorstát Eireann on full pay shall be conclusive evidence of that fact.

2. Any member of the Defence Force of Saorstát Eireann whose name is not included in the Electors Lists as entitled to be registered in the constituency in which he was ordinarily resident on the 15th day of October, 1922, or in which he would but for his service, have been ordinarily resident on the said 15th day of October, 1922, may claim to be registered by sending to the registration officer the prescribed form of claim containing the particulars required by the Electoral Act, 1923 , on or before the 19th day of May, 1923.

3. The registration officer shall prepare a list of any claims made under this Order, and shall publish such list by making the list available for inspection by the public in his office during ordinary office hours, and exhibiting a notice outside his office that such list is available for inspection.

4. The list of claims under this Order shall be published on the 26th day of May, 1923, and kept published until the 2nd day of June, 1923.

5. The provisions of Rule 12 in the First Schedule to the Electoral Act, 1923 , shall apply to the list of claims prepared under this Order in the same manner as it applies to a list of claimants provided that the 2nd day of June shall be substituted for the 26th day of March.

6. Any member of the Defence Force of Saorstát Eireann may, not later than the 19th day of May, 1923, claim not to vote by post.

7. The letter "a" shall be placed in the Register of Electors prepared pursuant to the Electoral Act, 1923 , opposite to the name of any member of the Defence Force included therein, and the name of any such person shall also be entered on the postal voters' list.

This rule shall not apply to any person who under Rule 6 of this Order has claimed not to vote by post.

8. This Order may be cited as the "Registration of Electors (Defence Force) Order, 1923".
