ARREARS AMENDMENT REGULATIONS, 1923.

REGULATIONS, DATED 13TH APRIL, 1923, MADE BY THE IRISH INSURANCE COMMISSIONERS, WITH THE CONCURRENCE OF THE MINISTER OF FINANCE, UNDER THE NATIONAL HEALTH INSURANCE ACTS, 1911 TO 1921.

The Irish Insurance Commissioners, in exercise of the powers conferred on them by the National Health Insurance Acts, 1911 to 1921, and of all other powers enabling them in that behalf, do hereby, with the concurrence of the Minister of Finance, make the following Regulations:—

1. These Regulations may be cited as the National Health Insurance (Arrears) Amendment Regulations, 1923,* and these Regulations, and the National Health Insurance (Arrears) Regulations, 1921 (S.R. & O., 1921, No. 1300) (hereinafter referred to as " the Principal Regulations "), and the National Health Insurance (Arrears) Amendment Regulations, 1922 (S.R. & O., 1922, No. 281), may be cited together as the National Health Insurance (Arrears) Regulations, 1921 to 1923.

2. Notwithstanding anything contained in Articles 11 & 12 of the Principal Regulations in the case of the contribution year ending on the 2nd day of July, 1922, the period of grace shall be the period up to and including the 30th day of November, 1922, or in the case of employed contributors, such longer period as the Irish Insurance Commissioners may in any particular case determine, and the date before which notices of arrears must be sent or delivered shall be the 1st day of October, 1922, and those Articles shall have effect as regards the contribution year ending on the 2nd day of July, 1922, accordingly.

* These Regulations supersede the Provisional Regulations entitled the National Health Insurance (Arrears) Amendment Regulations (No. 2), 1922, which were made on the 21st November, 1922.

3.—(1) For the purposes of the Principal Regulations a Society shall treat any member being an employed contributor who has satisfied the conditions specified in paragraph (b) of Sub-Section (2) of Section 1 of the National Health Insurance (Prolongation of Insurance) Act, 1921, and by or in respect of whom less than 26 contributions were paid for the contribution year ending on the 2nd day of July, 1922, as though the number of such contributions had been 26.

(2) For the purposes of this Article a member who, by virtue of the National Health Insurance (Arrears) Amendment Regulations, 1922, was treated as though the number of contributions paid by or in respect of him had been 26 for the preceding contribution year shall be deemed to have satisfied the conditions specified in paragraph (b) aforesaid.

(3) This Article shall not apply to any member who entered into Insurance after the 31st day of December, 1920, and shall not apply to any other member until contribution cards, to which stamps have been duly affixed in respect of any period of employment comprised in the contribution year ending on the 2nd day of July, 1922, have been surrendered by him to the Society.

4. The words "not otherwise" at the end of sub-paragraph (b) of paragraph (2) of Article 3 of the Principal Regulations shall be deleted, and in lieu thereof the words "unless the Irish Insurance Commissioners in any particular case otherwise determine not in respect of any period before the date of notice" shall be inserted.

5. The proviso to Article 15 of the Principal Regulations shall be read as if the words "which extends over the end of the said perior of twelve months and" were omitted therefrom.

6. Proviso (i) to Article 17 of the Principal Regulations shall have effect as if the words "or in the case of a card lost in the post the date on which it was posted" were inserted after the words "notice of the loss or destruction of the said card was given."

7. The words "unless the Irish Insurance Commissioners in any particular case otherwise determined" shall be inserted after the words "benefits shall not," and before the words "take effect" in proviso (ii) to Article 17 of the Principal Regulations.

8. The following words shall be added to paragraph (3) of Article 24 of the Principal Regulations:—

"Provided that the provisions of Article 17 of these Regulations with regard to the revision of rates of Benefit as from other dates where a card has been lost or destroyed or delivered to the Irish Insurance Commissioners, or where contributions have been recovered by the Commissioners, shall apply to a revision of the rates of Benefit under this paragraph."

9. Article 27 of the Principal Regulations is hereby revoked, but without prejudice to any right, obligation or liability acquired, accrued or incurred thereunder.
