PROVISIONAL COLLECTION OF TAXES ACT, 1913, ADAPTATION ORDER, 1923.

WHEREAS by Section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), the Executive Council of Saorstát Eireann is empowered from time to time by order to make all such general or specific adaptations of or modifications in any British Statute which in the opinion of the Executive Council are necessary in order to enable such statute to have full force and effect in Saorstát Eireann.

AND WHEREAS in the opinion of the Executive Council the adaptations and modifications intended to be made by this Order of and in the Statute of the late United Kingdom entitled the Provisional Collection of Taxes Act, 1913 (3 Geo. 5, ch. 3), being a " British Statute " within the meaning of the said Adaptation of Enactments Act, 1922 , are necessary in order to enable that statute to have full force and effect in Saorstát Eireann :

NOW, the Executive Council of Saorstát Eireann, in exercise of the power in this behalf conferred on them by the said Section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), and of every and any other power them in this behalf enabling, do hereby order as follows:—

1. This Order may be cited for all purposes as the " Provisional Collection of Taxes Act, 1913, Adaptation Order, 1923. "

2. In this Order the expression " Principal Act " means the " Provisional Collection of Taxes Act, 1913. "

3. Every mention or reference contained in the Principal Act of or to the Committee of Ways and Means of the House of Commons shall, as respects the doing or not doing after the 6th day of December, 1922, of any act, matter or thing in Saorstát Eireann, be construed and take effect as a mention of or reference to the Committee on Finance of Dáil Eireann.

4. As respects the doing or not doing after the 6th day of December, 1922, of any act, matter of thing in Saorstát Eireann, the expression " Act of Parliament, " wherever the same occurs in the Principal Act shall, in so far as such expression refers to an Act passed on or before the 6th day of December, 1922, mean an Act of the Parliament of the late United Kingdom of Great Britain and Ireland, and in so far as such expression refers to an Act passed or to be passed after the 6th day of December, 1922, shall mean an Act of the Oireachtas.

5. The Adaptations of the Principal Act made by this Order shall be in addition and without prejudice to the several adaptations of the modifications in the Principal Act effected by the Adaptation of Enactments Act, 1922 (No. 2 of 1922).

6. The Interpretation Act, 1889, applies to the interpretation of this Order in like manner as it applies to the interpretation of an Act of the Oireachtas.
