S.I. No. 21/1923 - Trade Boards Acts, 1909-1918.

REGULATIONS, DATED 30TH OCTOBER, 1923, MADE BY THE MINISTER OF INDUSTRY AND COMMERCE UNDER SECTION 18 OF THE TRADE BOARDS ACT, 1909, AMENDING THE REGULATIONS MADE ON THE 31ST OCTOBER, 1918, AS TO THE MODE OF GIVING NOTICE OF MATTERS OF WHICH NOTICE HAS TO BE GIVEN UNDER THE TRADE BOARDS ACTS, 1909 AND 1918.

The Minister of Industry and Commerce, in pursuance of his powers under Section 18 of the Trade Boards Act, 1909, and of every other power him hereunto enabling, hereby makes the following Regulations :—

(1) These Regulations shall be read and construed as one with the Regulations made under Section 18 of the Trade Boards Act, 1909, on the 31st day of October, 1918 (a) (hereinafter referred to as " the principal Regulations ").

(2) The following Regulation shall be substituted for Regulation 2 of the principal Regulations :—

When a Trade Board propose to fix, cancel or vary any general minimum time-rate, or any general minimum piece-rate, or any guaranteed time-rate, or any overtime rate, or any piece-work basis time-rate, they shall :—

(a) insert a notice of their proposal to fix, cancel or vary the rate in the Iris Oifigiúil, intimating that, on application made to the Trade Board by or on behalf of persons en- gaged in the Trade, information will be given as to the rate proposed to be fixed, or the proposed cancellation or variation of the rate, and that objections to the proposal may be lodged with the Trade Board within two months of the date on which the said notice is published in the Iris Oifigiúil; and

(a) S. R. & O., 1918, No. 1439.

(b) As soon as may be after the publication of the notice in the Iris Oifigiúil send a notice to all employers engaged in the trade, or, if the proposal applies to any special area, to all employers engaged in the trade in that special area, so far respectively as their names and addresses are known to the Trade Board, setting out the rate proposed to be fixed, or the proposed cancellation or variation of the rate, as the case may be, and requiring any objections to the proposal to be lodged with the Trade Board within the time specified in the notice mentioned in sub-paragraph (a) above.

(3) The following paragraph shall be inserted at the end of Regulation 6 of the principal Regulations:—

Where there is in force an order fixing a series of minimum rates to come into operation successively on the expiration of specified periods or an order so varying a rate that the variation shall be operative only during a specified period, if any such periods are determined by reference to changes in the cost of living or other similar contingency the Trade Board shall before the commencement of any such period give notice of the date upon which the period will begin and of the rates which will, under the order aforesaid, be in operation during that period.

(4) The following clause shall be inserted at the end of Regulation 7 of the principal Regulations:—

Where a notice (given under Regulation 6) that an order has been made confirming a variation of any minimum rate or a notice (given under Regulation 4) that a Trade Board have varied any special minimum piece-rate refers to some prior notice or notices in such manner that it must, to be properly understood, be read in conjunction with such prior notice or notices, or some part or parts thereof, a sufficient number of true copies of that notice and of the notice or notices to which it refers shall be posted and kept posted in manner aforesaid together, so that that notice and the notice or notices or part or parts thereof to which it refers may be read and construed as one notice.

(5) The following Regulation shall be inserted after Regulation 8 of the principal Regulations:—

8A. Where a notice applies only to a special process in the work of the Trade or a class of workers in the trade or a class of workers in a special process, an occupier shall be under no obligation to post or keep posted such notice so long as no workers are employed by him or on his premises to whom any of the rates set out in the Notice are applicable.

(6) These Regulation shall come into operation on the 19th day of November, 1923.

These Regulations may be cited as The Trade Boards Acts, 1909-1918 (Amendment) Regulations, 1923.
