1923. No. 17.ORDER OF THE DEPARTMENT OF AGRICULTURE AND TECHNICAL INSTRUCTION.

FOOT AND MOUTH DISEASE (IMPORTATION OF ANIMALS AND POULTRY) ORDER OF 1923.

THE Department of Agriculture and Technical Instruction, by virtue and in exercise of the powers vested in them under the joint operation of the Agriculture and Technical Instruction (Ireland) Act, 1899, and of the Diseases of Animals Acts, 1894 to 1914, and of every other power enabling them in this behalf. do, with the concurrence of the Minister for Agriculture, hereby order:—

1 Interpretation.

1. In this Order—

" The Department " means the Department of Agriculture and Technical Instruction.

" Animals " means horses, asses and mules, dogs, foxes, hares and rabbits.

" Poultry " means live domestic fowls, turkeys, geese, ducks guinea fowls, and pigeons.

2 Landing of Animals and Poultry Prohibited.

2. Unless and until the Department otherwise order, it shall be unlawful to land in Saorstát Eireann animals or poultry from any port or place in Great Britain except as hereinafter expressly provided.

3 Exceptions.

3. This Order shall not apply to the landing of animals or poultry coming from a district that has been free from Foot and Mouth Disease for two months previously, and in respect of which a duly completed Certificate in, or to the same effect as, the Form in the Schedule to this Order is produced and delivered immediately before landing,

(a) in the case of dogs, foxes, hares and rabbits and poultry, to an Officer of Customs and Excise ; or

(b) in the case of horses, asses and mules, to an Inspector of the Department.

4 Saving for existing Order.

4. Nothing in this Order shall interfere with the operation of the Importation of Horses, Asses and Mules (Ireland) Order of 1907.

5 Proceedings under Customs Acts.

5. Dogs, foxes, hares and rabbits shall be animals, and live poultry shall be things for the purposes of Section fifty-six (Unlawful Landing) of the Diseases of Animals Act, 1894, and of this Order.

6 Offences.

6. If any animals or poultry shall be landed in contravention of this Order, the owner thereof, and the owner and lessee, and the occupier of the place of landing, and the person causing, directing, or permitting the landing, and the owner or charterer and the master of the vessel from which the same is landed, shall, each according to and in respect of his own acts and defaults, be deemed guilty of an offence against the Diseases of Animals Act, 1894.

7 Commencement.

7. This Order shall come into operation on the first day of January, 1924.

8 Short Title.

8. This Order may be cited as the Foot and Mouth Disease (Importation of Animals and Poultry) Order of 1923.
