S.I. No. 269/2026 - Protected Disclosures Act 2014 (Disclosure to Prescribed Persons) (Amendment) Order 2026


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 16th June, 2026.

I, JACK CHAMBERS, Minister for Public Expenditure, Infrastructure, Public Service Reform and Digitalisation, in exercise of the powers conferred on me by section 7 (2) of the Protected Disclosures Act 2014 (No. 14 of 2014) (as adapted by the Public Expenditure, National Development Plan Delivery and Reform (Alteration of Name of Department and Title of Minister) Order 2025 ( S.I. No. 243 of 2025 )), hereby order as follows:

1. This Order may be cited as the Protected Disclosures Act 2014 (Disclosure to Prescribed Persons) (Amendment) Order 2026.

2. The Schedule to the Protected Disclosures Act 2014 (Disclosures to Prescribed Persons) Order 2020 ( S.I. No. 367 of 2020 ) is amended –

(a) by the substitution of the following for reference number 7:

The chief executive officer of the Child and Family Agency

(a) All matters relating to the registration, supervision and inspection of early years services under Part VIIA of the Child Care Act 1991 (No. 17 of 1991) and regulations made under that Act.

(b) All matters relating to the registration and inspection of children’s residential centres under Part VIII of the Child Care Act 1991 and regulations made under that Act.

(c) All matters relating to the registration of children in receipt of education in a place other than a recognised school and the carrying out of assessments under section 14 of the Education (Welfare) Act 2000 (No. 22 of 2000).

(d) All matters relating to children in the care of the Child and Family Agency under Part VI of the Child Care Act 1991 and regulations made under that Act.

The Commissioner for Railway Regulation

(a) All matters relating to the regulation of railway safety in the State, including matters relating to railway and cableway safety on passenger carrying systems and freight carrying systems where those systems interface with public roads.

(b) All matters relating to market surveillance for cableway subsystems and components.

(c) All matters within the remit of the Commission for Railway Regulation relating to the regulation of the transportation of dangerous goods by rail.

(d) All matters within the remit of the Commission for Railway Regulation as the independent monitoring body for the infrastructure management contract under the European Union (Regulation of Railways) Regulations 2015 ( S.I. No. 249 of 2015 ).

(e) All matters relating to the licensing of railway undertakings within the meaning of the European Union (Regulation of Railways) Regulations 2015 ( S.I. No. 249 of 2015 ).

(f) All matters relating to the remit of the Commission for Railway Regulation in respect of critical entity resilience in the transport/rail sector and public transport services provided on a railway under the European Union (Resilience of Critical Entities) Regulations 2024 ( S.I. No. 559 of 2024 ).

(b) All matters relating to the settling of the maximum level of airport and aviation terminal services charges.

(c) All matters relating to the licensing of the travel trade in the State, including the granting of licences to tour operators and travel agents.

(d) All matters relating to the licensing of airlines and approval of groundhandling service providers.

(e) All matters relating to the discharge of the State’s responsibilities for schedule co-ordination and slot allocation and the appointment of a schedules facilitator and slot co-ordinator.

(f) All matters relating to the monitoring and enforcement in the State of acts adopted by an institution of the European Union regarding air passenger rights and the provision of assistance to passengers with reduced mobility.

(g) All matters relating to the monitoring and enforcement in the State of the Regulation (EU) 2023/2405 of the European Parliament and of the Council of 18 October 2023 on ensuring a level playing field for sustainable air transport (ReFuelEU Aviation) in respect of aircraft operators and Union airport management bodies.

All matters relating to the monitoring and supervision of the operation of the Pensions Act 1990 (No. 25 of 1990) (other than matters relating to the Pensions Council), including the activities of Personal Retirement Savings Account (PRSA) providers, the provision of PRSA products, the operation of PRSAs and the issue of guidelines and codes of practice for trustees of occupational pension schemes and providers of PRSAs.

(a) All matters relating to the provision of a safe and efficient network of national roads, including, in relation to national roads (or proposed national roads):

(i) preparing and arranging for the preparation of designs for construction or improvement works, programmes of maintenance (including maintenance works) and schemes for the provision of traffic signs,

(ii) securing the carrying out of construction and maintenance. the provision of traffic signs, and the provision of facilities for the parking of vehicles;

(iv) allocating moneys and making payments relating to construction or maintenance (including maintenance works), and

(v) for those national roads which are national managed roads (within the meaning of the Roads Act 1993 (No. 14 of 1993), the operation of speed limits.

(b) All matters relating to the procurement and the provision of light rail and metro infrastructure in the State including the making of relevant bye-laws and the prosecution of related offences.
