S.I. No. 151/2025 - Regulated Professions (Health and Social Care) (Amendment) Act 2020 (Commencement of Certain Provisions) Order 2025

Notice of the making of this Statutory Instrument was published in

I, JENNIFER CARROLL MACNEILL, Minister for Health, in exercise of the powers conferred on me by section 1 (2) of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (No. 16 of 2020), hereby order as follows:

1. This Order may be cited as the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (Commencement of Certain Provisions) Order 2025.

2. The 6^th day of May 2025 is appointed as the day on which the following provisions of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (No. 16 of 2020) shall come into operation:

(a) section 3;

(b) paragraphs (a) and (c) of section 4;

(c) paragraph (b) of section 4, insofar as that paragraph relates to the insertion of the following definitions in section 2 (1) of the Dentists Act 1985 (No. 9 of 1985):

(i) “appropriate fee”;

(ii) “condition”;

(iii) “Council website”;

(iv) “health or social care”;

(v) “relevant profession”;

(vi) “restriction”;

(d) section 6;

(e) sections 9 to 23;

(f) paragraph (b) of section 36;

(g) paragraph (a) of section 53;

(h) section 58, insofar as it relates to the insertion of section 21B of the Pharmacy Act 2007 (No. 20 of 2007);

(i) paragraph (b) of section 61;

(j) paragraph (b) of section 62;

(k) paragraph (a) of section 78;

(l) paragraph (b)(xii) of section 78, insofar as that paragraph relates to the insertion of the following definitions in section 2 (1) of the Medical Practitioners Act 2007 (No. 25 of 2007):

(i) “authorised officer”;

(ii) “health or social care”;

(iii) “investigation”;

(iv) “investigation report”;

(v) “relevant profession”;

(vi) “restriction”;

(m) paragraph (b) of section 79;

(n) paragraphs (a)(ii) and (c) of section 81;

(o) paragraphs (a) and (d) of section 84;

(p) sections 85 and 86;

(q) section 94;

(r) section 102;

(s) subparagraphs (i) and (ii) of section 109(a);

(t) paragraphs (b) to (f) of section 109;

(u) paragraph (g) of section 109, insofar as that paragraph is not already in operation;

(v) paragraphs (h) and (i) of section 109;

(w) sections 110 to 119;

(x) section 122;

(y) sections 131 and 132;

(z) sections 136 to 138;

(aa) section 140, insofar as that section relates to the insertion of section 105A of the Medical Practitioners Act 2007 ;

(ab) section 142;

(ac) section 149;

(ad) section 156;

(ae) section 158;

(af) section 159, insofar as that section is not already in operation.

EXPLANATORY NOTE

This Order appoints 6^th May 2025 as the day on which certain sections of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (No. 16 of 2020) shall come into operation.

The provisions amend the Dentists Act 1985, the Health and Social Care Professionals Act 2005 , the Pharmacy Act 2007 , the Medical Practitioners Act 2007 and the Nurses and Midwives Act 2011 .
