S.I. No. 121/2023 - European Union (Emission Allocation) Regulations 2023

I, EAMON RYAN, Minister for the Environment, Climate and Communications, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Article 3 of Decision No. 406/2009/EC of the European Parliament and of the Council of 23 April 20091 , hereby make the following regulations:

1. These Regulations may be cited as the European Union (Emission Allocation) Regulations 2023.

2. (1) In these Regulations –

“Decision” means Decision No. 406/2009/EC of the European Parliament and of the Council of 23 April 20091 on the effort of Member States to reduce their greenhouse gas emissions to meet the Community’s greenhouse gas emission reduction commitments up to 2020;

“Minister” means the Minister for the Environment, Climate and Communications.

(2) A word or expression that is used in these Regulations and is also used in the Decision has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Decision.

3. (1) For the purpose of ensuring compliance with the State’s obligations under Article 3 of the Decision and in accordance with paragraph (5) of that Article, the Minister may arrange for the purchase from another Member State of that Member State’s surplus annual emission allocation and the Minister may take any other such steps as are necessary for that purpose.

(2) The costs and expenses incurred by the Minister in the performance of his or her functions under paragraph (1) shall, to such extent as may be sanctioned by the Minister for Public Expenditure, National Development Plan Delivery and Reform, be paid out of monies provided by the Oireachtas.
