S.I. No. 667/2022 - Immigration Act 2004 (Registration Certificate Fee) (Amendment) Regulations 2022

I, HEATHER HUMPHREYS, Minister for Justice, in exercise of the powers conferred on me by section 19 (as amended by section 34 of the Civil Law (Miscellaneous Provisions) Act 2022 (No. 19 of 2022)) and section 20 of the Immigration Act 2004 (No. 1 of 2004) (as adapted by the Justice and Equality (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 452 of 2020 )), hereby make the following regulations:

1. These Regulations may be cited as the Immigration Act 2004 (Registration Certificate Fee) (Amendment) Regulations 2022.

2. Regulation 4 of the Immigration Act 2004 (Registration Certificate Fee) Regulations 2012 ( S.I. No. 444 of 2012 ) is amended-

(a) in paragraph (k), by the substitution of “in force;” for “in force.”, and

(b) by the insertion of the following paragraph after paragraph (k):

“(l) persons to whom the Minister has granted a residence permission in accordance with the International Protection Regularisation Scheme, which permission is still valid.”.

EXPLANATORY NOTE

These Regulations amend the Immigration Act 2004 (Registration Certificate Fee) Regulations 2012 ( S.I. No. 444 of 2012 ) to provide that persons who hold a valid residence permission granted in accordance with the International Protection Regularisation Scheme are exempt from paying the fee for obtaining a registration certificate.
