I, HEATHER HUMPHREYS, Minister for Social Protection, in exercise of the powers conferred on me by sections 4 (adapted by the Employment Affairs and Social Protection (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 447 of 2020 )) and 3(1)(f) of the Social Welfare Consolidation Act 2005 , hereby make the following Regulations:

Citation and construction

(1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 14) (Income Limit - Qualified Adult) Regulations 2022.

(2) These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2022 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2022.

Income limit - qualified adult

Article 7 of the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 is amended, by the substitution of “141, 149, 210 and 214” for “141(2)(d), 149(4), 210(2) and 214(2)” in each place that it occurs.

EXPLANATORY NOTE

These Regulations concern means assessments for qualified adults who are a spouse, civil partner, or a cohabitant of a recipient of jobseeker’s allowance, disability allowance, farm assist, or pre-retirement allowance.

The Regulations provide that the income of a spouse, civil partner, or a cohabitant derived from employment or self-employment is treated in the same way as other forms of income in determining if that person is to be considered to be wholly or mainly maintained by the recipient of the core social welfare payment.
