S.I. No. 319/2022 - Forestry (Amendment) Regulations 2022


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 1st July, 2022.

I, Charlie McConalogue, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 6 , 22 and 30 of the Forestry Act 2014 (No. 31 of 2014) and for the purpose of giving effect to Directive 2009/147/EC of the European Parliament and of the Council of 30 November 20091 and Council Directive 92/43/EEC of 21 May 19922 in so far as those Directives relate to forestry related development, hereby make the following regulations:

1. These Regulations may be cited as the Forestry (Amendment) Regulations 2022.

2. The Forestry Regulations 2017 ( S.I. No. 191 of 2017 ) are amended In Regulation 8 (3), by-

(a) deleting subparagraph (d), and

(b) substituting for subparagraph (f) the following:

“(f) 20 metres of -

(i) a monument or place recorded under section 12 of the National Monuments (Amendment) Act 1994 (No. 17 of 1994),

(ii) a historic monument or archaeological area entered in the Register of Historic Monuments under section 5 of the National Monuments (Amendment) Act 1987 (No. 17 of 1987), or

(iii) a national monument in the ownership or guardianship of the Minister for Housing, Local Government and Heritage under the National Monuments Acts 1930 to 2014.”.
