S.I. No. 484/2021 - Worker Participation (State Enterprises) Act 1988 (Section 9) Order 2021


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24th September, 2021.

WHEREAS Aer Rianta International cpt (ARI) and daa International Ltd (daaI) are subsidiaries of daa plc to which section 9 of the Worker Participation (State Enterprises) Act 1988 (No. 13 of 1988), applies:

AND WHEREAS daa plc and representatives of employees of that company have jointly made a request in writing to the Minister for Transport for the making of this Order, and that company has sent a copy of the request to Mr LEO VARADKAR, T.D., Tánaiste and Minister for Enterprise, Trade and Employment.

NOW, I, DAMIEN ENGLISH, Minister of State for Business, Employment and Retail, in exercise of the powers conferred on me by the said section 9 (as adapted by the Enterprise, Trade and Innovation (Alteration of Name of Department and Title of Minister) Order 2020 (S.I. 519 of 2020) and the Enterprise, Trade and Employment (Delegation of Ministerial functions) Order 2020 (S.I. 579 of 2020)) and after consultation with the Minister for Public Expenditure and Reform and the Minister for Transport hereby make the following order:

1. This Order may be cited as the Worker Participation (State Enterprises) Act 1988 (Section 9) Order 2021.

2. Every employee of Aer Rianta International cpt (ARI) shall, for the purposes of the Worker Participation (State Enterprises) Acts 1977 to 2001, be regarded as an employee of daa plc.

3. Every employee of daa International Ltd (daaI) shall, for the purposes of the Worker Participation (State Enterprises) Acts 1977 to 2001, be regarded as an employee of daa plc.

The effect of this Order is to allow employees of Aer Rianta International cpt (ARI) and daa International Ltd (daaI) to participate in the election of employee representatives to the board of daa plc.
