S.I. No. 409/2021 - Regulated Professions (Health and Social Care) (Amendment) Act 2020 (Commencement) (No. 3) Order 2021


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd August, 2021.

I, STEPHEN DONNELLY, Minister for Health, in exercise of the powers conferred on me by section 1 (2) of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (No. 16 of 2020), hereby order as follows:

1. This Order may be cited as the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (Commencement) (No. 3) Order 2021.

2. The 1st day of August 2021 is appointed as the day on which the following provisions of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 (No. 16 of 2020) shall come into operation:

(a) section 60;

(b) section 74 in so far as it is not already in operation;

(c) sections 143 to 148;

(d) sections 150 to 155;

(e) section 157;

(f) section 159 other than subsection (b) insofar as that subsection inserts (2A) into section 55 of the Act of 2011;

(g) sections 160 to 185.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order appoints 1st August 2021 as the day on which certain provisions of the Regulated Professions (Health and Social Care) (Amendment) Act 2020 come into operation.

The sections being commenced amend the Nurses and Midwives Act 2011 mainly in relation to registration and fitness to practise.

The Order also commences sections which amend the Pharmacy Act 2007 in relation to membership of disciplinary committees and in relation to reports by authorised officers.
