S.I. No. 408/2021 - European Union (Counterfeiting of Euro) Regulations 2021


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 3rd August, 2021.

I, PASCHAL DONOHOE, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Regulation (EC) No. 1338/2001 of 28 June 20011 laying down measures necessary for the protection of the euro against counterfeiting, as amended by Council Regulation (EC) No. 44/2009 of 18 December 20082 , Regulation (EU) No. 1210/2010 of the European Parliament and of the Council of 15 December 20103 concerning authentication of euro coins and handling of euro coins unfit for circulation and Decision ECB/2010/14 of the European Central Bank of 16 September 20104 on the authenticity and fitness checking and recirculation of euro banknotes, as amended by Decision ECB/ 2012/19 of 7 September 20125 and by Decision ECB/2019/2195 of 5 December 20196 ; hereby make the following regulations:

1. (1) These Regulations may be cited as the European Union (Counterfeiting of Euro) Regulations 2021.

(2) These Regulations shall come into operation on the 3rd day of August 2021.

2. The Central Bank Act 1942 (No. 22 of 1942) is amended -

(a) in section 2(2A) –

(i) in paragraph (ba) (inserted by Regulation 5 of the European Union (Sustainability-related Disclosures in the Financial Services Sector) Regulations 2021 ( S.I. No. 146 of 2021 )), by the substitution of “2019;” for “2019.”, and

(ii) by the insertion of the following paragraphs after paragraph (ba):

“(bb) Council Regulation (EC) No. 1338/2001 of 28 June 20011 laying down measures necessary for the protection of the euro against counterfeiting, as amended by Council Regulation (EC) No. 44/2009 of 18 December 20082 ;

(bc) Regulation (EU) No. 1210/2010 of the European Parliament and of the Council of 15 December 20103 concerning authentication of euro coins and handling of euro coins unfit for circulation;

(bd) Decision ECB/2010/14 of the European Central Bank of 16 September 20104 on the authenticity and fitness checking and recirculation of euro banknotes, as amended by Decision ECB/2012/19 of 7 September 20125 and by Decision ECB/2019/2195 of 5 December 20196 .”,

and

(b) in Part 1 of Schedule 2 by the insertion of the following:

“49 No. 16 of 2021 Counterfeiting Act 2021 Part 3”.
