S.I. No. 222/2021 - Education (Delegation of Ministerial Functions) Order 2021


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 7th May, 2021.

The Government, on the request of the Minister for Education (as adapted by the Education and Skills (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 450 of 2020 )) and in exercise of the powers conferred on them by section 2 (1) of the Ministers and Secretaries (Amendment) (No. 2) Act 1977 (No. 28 of 1977), hereby order as follows:

1. This Order may be cited as the Education (Delegation of Ministerial Functions) Order 2021.

2. The powers and duties of the Minister for Education conferred on her by or under the provisions of the Acts of the Oireachtas specified in the Schedule are delegated to Josepha Madigan, Minister of State at the Department of Education.

SCHEDULE

Section 7(1)(a) of the Education Act 1998 (No. 51 of 1998), in so far as that paragraph relates to persons with a disability or other special educational needs (both within the meaning of section 2(1) of that Act)

Subsections (3) and (4) of section 7 of the Education Act 1998 , in so far as those subsections relate to the performance of the functions under that Act delegated by this order

Section 33(i) and (j)(iv) of the Education Act 1998

Section 37A (inserted by section 8 of the Education (Admission to Schools) Act 2018 (No. 14 of 2018)) of the Education Act 1998

Sections 21, 22 and 28 of, and Schedule 1 to, the Education for Persons with Special Educational Needs Act 2004 (No. 30 of 2004)
