S.I. No. 546/2020 - Road Traffic (Licensing of Drivers) (Amendment) (No. 10) Regulations 2020

I, EAMON RYAN, Minister for Transport, in exercise of the powers conferred on me by sections 5 (1) and 42(3)(c) of the Road Traffic Act 1961 (No. 24 of 1961) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Transport, Tourism and Sport (Alteration of Name of Department and Title of Minister) Order 2020 ( S.I. No. 351 of 2020 )), hereby make the following regulations:

1. (1) These Regulations may be cited as the Road Traffic (Licensing of Drivers) (Amendment) (No. 10) Regulations 2020.

(2) These Regulations come into operation on 30 November 2020.

2. In these Regulations, “Regulations of 2006” means the Road Traffic (Licensing of Drivers) Regulations 2006 ( S.I. No. 537 of 2006 ).

3. The Regulations of 2006 are amended by the substitution of the following Regulation for Regulation 28:

“28. (1) A person may apply for a certificate of competency -

(a) by post, on a form approved by the issuing authority, or

(b) online, by means of an online application system provided by or on behalf of the issuing authority.

(2) A form or application system referred to in paragraph (1) shall contain the particulars specified in Parts 1 and 2 of Schedule 10.

(3) A person applying for a certificate of competency shall provide the particulars set out in Part 1 of Schedule 10 and may provide the particulars set out in Part 2 of that Schedule.”.

4. The Regulations of 2006 are amended -

(a) in Schedule 1, by the deletion of scheduled form D.301, and

(b) by the insertion of the following Schedule after Schedule 9:

“SCHEDULE 10

Part 1

1. Driver number, being -

(a) in the case of a driving licence in scheduled form D.402, the number given at item 4d,

(b) in the case of a driving licence issued before 19 January 2013, the number given at item 5 and described as ‘Number’, or

(c) in the case of a learner permit in scheduled form D.202, the number given at item 4d.

2. First name.

3. Surname.

4. Address.

5. Date of birth.

6. The category of vehicle in respect of which the application for a certificate of competency is made.

7. The place, being a place determined under Regulation 26(5), at which the applicant wishes to take the test for a certificate of competency.

8. A declaration, signed by the applicant, stating that the applicant wishes to book a test for a certificate of competency, that the information being given in the application is correct, and that the applicant understands that to give false or misleading information is an offence.

9. The date of the application.

Part 2

1. Gender.

2. Title.

3. Eircode.

4. Email address.

5. Mobile telephone number.

6. An indication as to whether the applicant requires a special accommodation in order to facilitate him or her in completing the test for a certificate of competency.

7. An indication as to whether or not the applicant wishes to have the test conducted through the Irish language.

8. An indication as to whether or not the applicant wishes to receive notification if an earlier test date becomes available.”.

These Regulations amend the Road Traffic (Licensing of Drivers) Regulations 2006 (S.I. 537 of 2006) in order to enhance the online application system for driving tests.
