S.I. No. 182/2020 - Bovine Viral Diarrhoea (Amendment) Regulations 2020


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 26th May, 2020.

I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 36 of the Animal Health and Welfare Act 2013 ( S.I. No. 15 of 2013 ), hereby make the following Regulations:

1. These Regulations may be cited as the Bovine Viral Diarrhoea (Amendment) Regulations 2020 and come into operation on 22 May 2020.

2. The Bovine Viral Diarrhoea Regulations 2017 are amended –

(a) by the substitution, for Regulation 3 (2) of -

“(2) Paragraph (1) does not apply to –

(a) a bovine from which a sample was taken under the Bovine Viral Diarrhoea Order 2012 or the Bovine Viral Diarrhoea Regulations 2014, or

(b) a cow from whose calf a sample was taken and tested for the presence of bovine viral diarrhoea virus before the commencement of the Bovine Viral Diarrhoea (Amendment) Regulations 2020.”,

(b) in Regulation 9 (1) by deleting “born after 1 January 2013,”,

(c) in Regulation 9 (2) by deleting “born on or after 1 January 2013,”, and

(d) In Regulation 10 (1) by deleting “a bovine born on or after 1 January 2013, or,”.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation)

The effect of these Regulations is to provide for the compulsory testing of all bovines born before 1 January 2013 for the presence of the bovine viral diarrhoea virus, with the exception of those female bovines for which a valid BVD virus test result is recorded for one or more offspring.
