S.I. No. 133/2020 - Commercial Vehicle Roadworthiness (Vehicle Testing) (Amendment) Regulations 2020


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 24th April, 2020.

The Minister for Transport, Tourism and Sport in exercise of the powers conferred on him by sections 4 and 5 of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012), hereby makes the following regulations:

1. These Regulations may be cited as the Commercial Vehicle Roadworthiness (Vehicle Testing) (Amendment) Regulations 2020.

2. In these Regulations “Commercial Vehicle Roadworthiness (Vehicle Testing) (No. 2) Regulations” means the Commercial Vehicle Roadworthiness (Vehicle Testing) (No. 2) Regulations 2013 ( S.I. No. 347 of 2013 ).

3. The Commercial Vehicle Roadworthiness (Vehicle Testing) (No. 2) Regulations are amended -

(a) by the insertion of the following Regulations after Regulation 6:

“6A. Notwithstanding Regulation 6 and 7 and subject to Regulation 6B, the test due date for a CVR vehicle of a class specified in column (2) of Schedule 1 at reference numbers 1 to 12 in column (1) of the Schedule shall be the date which is three months from each test due date for that vehicle determined in accordance with Regulation 6 or 7, as the case may be.

6B. Regulation 6A applies to a CVR vehicle specified in column (2) of Schedule 1 at reference numbers 1 to 12 in column (1) of the Schedule, where -

(a) the first test due date of the vehicle, determined in accordance with Regulation 6, falls during the period beginning on 28 March 2020 and ending on 30 June 2020, or

(b) a certificate of roadworthiness in respect of the vehicle was in force on 28 March 2020.”,

and

(b) in Regulation 27, by the insertion of the following paragraph after paragraph (6):

“(7) A certificate of roadworthiness issued under these Regulations, in respect of a CVR vehicle to which Regulation 6A applies, which is valid on 28 March 2020 shall continue to be valid and the date of expiry of the certificate in respect of that vehicle (including the attached disc which relates to that certificate) shall be three months from the date of expiry specified on the certificate to be the date of its expiry.”.

EXPLANATORY NOTE

These Regulations amend the Commercial Vehicle Roadworthiness (Vehicle Testing) (No. 2) Regulations 2013 ( S.I. No. 347 of 2013 ) to provide that a 3 month extension is given to test due dates for CVR vehicles with a first test due falling during the period beginning on 28 March 2020 and ending on 30 June 2020, or to CVR vehicles with a certificate of roadworthiness in force on 28 March 2020.
