S.I. No. 354/2019 - Residential Tenancies (Amendment) Act 2019 (Commencement) (No. 3) Order 2019


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 19th July, 2019.

The Minister for Housing, Planning and Local Government, in exercise of the powers conferred on him by subsection (4) of section 1 of the Residential Tenancies (Amendment) Act 2019 (No. 14 of 2019), hereby orders as follows:

1. This Order may be cited as the Residential Tenancies (Amendment) Act 2019 (Commencement) (No. 3) Order 2019.

2. The 15th day of July 2019 is appointed to be the day on which the following provisions of the Residential Tenancies (Amendment) Act 2019 (No. 14 of 2019) shall come into operation:

(a) sections 3, 4, 5, 18 and 37;

(b) subparagraphs (ii), (iii) and (iv) of paragraph (b) of subsection (1) of section 22;

(c) subparagraphs (ii) and (iii) of paragraph (b) of subsection (1) of section 23; and

(d) paragraph (a) (in so far only as it relates to paragraph (b) of subsection (1) of section 137 of the Residential Tenancies Act 2004 (No. 27 of 2004)) and paragraph (c) (in so far only as it relates to paragraph (b) of subsection (4) of the said section 137) of subsection (1) of section 25.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order appoints 15 July 2019 as the date on which the specified provisions of the Residential Tenancies (Amendment) Act 2019 come into effect.

The specified provisions apply, as appropriate, the Residential Tenancies Acts 2004-2019 to tenancies and licences between students and the owners of student-specific accommodation. For example, such accommodation provided privately or by a public educational institution will become subject to the annual rent increase restriction in Rent Pressure Zones (RPZs). Tenancies and under section 37 of the Residential Tenancies (Amendment) Act 2019 , licences in student-specific accommodation, will be required to be registered with the Residential Tenancies Board (RTB) and its dispute resolution service will become available to that sector.
