S.I. No. 198/2019 - European Communities (Marketing Of Fruit Plant Propagating Material) (Amendment) Regulations 2019

I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Implementing Decision (EU) 2019/120 of 24 January 20191 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Marketing of Fruit Plant Propagating Material) (Amendment) Regulations 2019.

2. The European Communities (Marketing of Fruit Plant Propagating Material) Regulations 2011 ( S.I. No. 384 of 2011 ) are amended in Regulation 2(1) by substituting for the definition of “Directive”, the following –

“‘Directive’ means Council Directive 2008/90/EC of 29 September 20082 (as amended by Regulation (EU) No 652/2014 of the European Parliament and of the Council of 15 May 20143 , Commission Implementing Decision (EU) 2016/159 of 4 February 20164 , Commission Implementing Decision (EU) 2016/1887 of 24 October 20165 and Commission Implementing Decision (EU) 2019/120 of 24 January 2019, Commission Implementing Directive 2014/96/EU of 15 October 20146 , Commission Implementing Directive 2014/97/EU of 15 October 20147 and Commission Implementing Directive 2014/98/EU of 15 October 20148 ;”.

3. The European Communities (Marketing of Fruit Plant Propagating Material (Amendment) Regulations 2017 ( S.I. No. 39 of 2017 ) are revoked.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations provide for the extension from 31 December 2018 until 31 December 2022, the period in which a Member State may decide whether propagating material and fruit plants produced in a third country and affording the same guarantees as regards obligations on the supplier, identity, characteristics, plant health, growing medium, packaging, inspection arrangements, marking and sealing are equivalent to those produced in the Union.
