I, EOGHAN MURPHY, Minister for Housing, Planning and Local Government, in exercise of the powers conferred on me by subsection (4A) (inserted by paragraph (b) of subsection (1) of section 17 of the Environment (Miscellaneous Provisions) Act 2011 (No. 20 of 2011)) of section 4 of the Planning and Development Act 2000 (No. 30 of 2000) (as adapted by the Housing, Planning, Community and Local Government (Alteration of Name of Department and Title of Minister) Order 2017 ( S.I. No. 358 of 2017 )), hereby make the following regulations:

1. (1) These Regulations may be cited as the Planning and Development Act 2000 (Exempted Development) Regulations 2019.

(2) These Regulations shall come into operation on 25th January 2019.

2. The Planning and Development Regulations 2001 ( S.I. No. 600 of 2001 ) are amended by the insertion of the following article:

“8H. (1) Peat extraction within the meaning of the Act of 1992 shall be exempted development.

(2) Development necessary to enable compliance with a condition attached to a licence or revised licence under Part IV of the Act of 1992 to carry on peat extraction referred to in paragraph (1) shall be exempted development.

(3) In this article ‘Act of 1992’ means the Environmental Protection Agency Act 1992 (No. 7 of 1992).”.

EXPLANATORY NOTE

(This note is not part of the instrument and does not purport to be a legal interpretation.)

Article 2 of these Regulations amend the Planning and Development Regulations 2001, as amended, by inserting a new Article 8H to provide that peat extraction within the meaning of the Environmental Protection Agency Act 1992 (No. 7 of 1992), and any development necessary to comply with a condition attached to a licence or revised licence under Part IV of that Act to carry on such peat extraction, is exempt from the requirement to obtain planning permission.
