S.I. No. 104/2019 - Housing (Financial Assistance) Regulations 2019

I, EOGHAN MURPHY, Minister for Housing, Planning and Local Government, in exercise of the powers conferred on me by section 5 of the Housing Act 1966 (No. 21 of 1966) and subsection (4) of section 10 of the Housing Act 1988 (No. 28 of 1988) (as adapted by the Housing, Planning, Community and Local Government (Alteration of Name of Department and Title of Minister) Order 2017 ( S.I. No. 358 of 2017 )), with the consent of the Minister for Public, Expenditure and Reform, hereby make the following regulations:

1. These Regulations may be cited as the Housing (Financial Assistance) Regulations 2019.

2. A payment made by a housing authority under subsection (1) of section 10 of the Housing Act 1988 (No. 28 of 1988) to a homeless person for the purpose of enabling him to pay a deposit in respect of a tenancy to which he is a party shall not be recouped under subsection (4) of that section unless –

(a) the homeless person is a qualified household within the meaning of Part 4 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014),

(b) the tenancy is a tenancy within the meaning of that Part, and

(c) the housing authority has made a decision to provide housing assistance under that Part in respect of the dwelling to which that tenancy applies.
