S.I. No. 102/2019 - Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 4) (Change in Rates) Regulations 2019

I, REGINA DOHERTY, Minister for Employment Affairs and Social Protection, in exercise of the powers conferred on me by sections 3 , 4 (amended by section 96 of the Ministers and Secretaries (Amendment) Act 2011 (No. 10 of 2011)), 41 , 53 , 64 , 109 (9), 109 (10), 109 (15) and 178A of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), and by sections 2(2), 109(8) (amended by section 4 of the Social Welfare Act 2012 (No. 43 of 2012)), 109(14) (amended by section 4 of the Social Welfare Act 2012 ), 125 and 297 of the Social Welfare Consolidation Act 2005 , with the consent of the Minister for Public Expenditure and Reform, hereby make the following Regulations:

Citation and construction

1. (1) These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 4) (Change in Rates) Regulations 2019.

(2) These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2019 shall be construed together as one and may be cited together as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to 2019.

Commencement

2. These Regulations come into operation–

(a) in so far as they relate to jobseeker’s allowance, pre-retirement allowance and farm assist, on 20 March 2019,

(b) in so far as they relate to jobseeker’s benefit, on 21 March 2019,

(c) in so far as they relate to illness benefit, health and safety benefit and injury benefit on 25 March 2019,

(d) in so far as they relate to disability allowance, on 27 March 2019,

(e) in so far as they relate to invalidity pension and a payment referred to in paragraph (a) of the definition of “relevant payment” in section 178(1) of the Social Welfare Consolidation Act 2005 on 28 March 2019, and

(f) in so far as they relate to State pension (contributory), widow’s (contributory) pension, widower’s (contributory) pension and surviving civil partner’s (contributory) pension, on 29 March 2019.

Amendment of Schedules to Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007

3. The Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) are amended–

(a) by the substitution of the Schedule set out in Schedule 1 to these Regulations for Schedule 1,

(b) by the substitution of the Schedules set out in Schedule 2 to these Regulations for Schedules 2 and 2A,

(c) by the substitution of the Schedules set out in Schedule 3 to these Regulations for Schedules 3 and 3A,

(d) by the substitution of the Schedule set out in Schedule 4 to these Regulations for Schedule 4,

(e) by the substitution of the Schedules set out in Schedule 5 to these Regulations for Schedules 5, 6 and 6A,

(f) by the substitution of the Schedule set out in Schedule 6 to these Regulations for Schedule 7,

(g) by the substitution of the Schedules set out in Schedule 7 to these Regulations for Schedules 8, 8A and 8B,

(h) by the substitution of the Schedule set out in Schedule 8 to these Regulations for Schedule 9, and

(i) by the substitution of the Schedule set out in Schedule 9 to these Regulations for Schedule 11.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

Section 18 of the Social Welfare, Pensions and Civil Registration Act 2018 provides for increases in the maximum rates of certain social insurance payments arising from Budget 2019. These rates will apply where the contribution conditions and relevant weekly earnings or weekly income conditions are fully satisfied.

Where contribution conditions are partially satisfied, the Social Welfare Consolidation Act provides for Regulations to specify the reduced personal rates and for tapered increases for a qualified adult (where such a qualified adult has a weekly income).

These Regulations provide for increases to the reduced personal rates of Illness Benefit, Jobseeker’s Benefit, Health and Safety Benefit, State Pension (Contributory), Widow’s (Contributory) Pension, Widower’s (Contributory) Pension, and Surviving Civil Partner’s (Contributory) Pension. The reduced rates applicable for qualified adults in such cases are also increased.

The Regulations also provide for changes to the rates of tapered increases for qualified adults (whose income is between €100.01 and €310.00), of recipients of Illness Benefit, Jobseeker’s Benefit, Injury Benefit, Jobseeker’s Allowance, Pre-Retirement Allowance, Disability Allowance, Farm Assist and Invalidity Pension.

Finally, the Regulations provide for changes to the tapered increases for qualified adults (whose income is between €100.01 and €310.00), of recipients who are on reduced rates of State Pension (Contributory), Illness Benefit and Jobseeker’s Benefit.

These changes will take effect from 20 March 2019 to 5 April 2019 to coincide with the increases to the maximum rates for the schemes in question provided for in the Social Welfare, Pensions and Civil Registration Act 2018.
