S.I. No. 483/2018 - Ethics in Public Office (Designated Positions in Public Bodies) (Amendment) Regulations 2018

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 23rd November, 2018.

I, PASCHAL DONOHOE, Minister for Public Expenditure and Reform, in exercise of the powers conferred on me by section 3 of the Ethics in Public Office Act 1995 (No. 22 of 1995) (as adapted by the Finance (Transfer of Departmental Administration and Ministerial Functions) Order 2011 ( S.I. No. 418 of 2011 )) and after consultation with every Minister of the Government, hereby make the following regulations:

1. These Regulations may be cited as the Ethics in Public Office (Designated Positions in Public Bodies) (Amendment) Regulations 2018.

2. The Ethics in Public Office (Designated Positions in Public Bodies) Regulations 2004 ( S.I. No. 698 of 2004 ) are amended—

(a) by substituting for Regulation 6 (amended by Regulation 2(a) of the Ethics in Public Office (Designated Positions in Public Bodies) (Amendment) Regulations 2015 ( S.I. No. 35 of 2015 )) the following:

“6.The following offices are prescribed for the purposes of section 18(3)(b)(v) of the Act:

(a) Comptroller and Auditor General;

(b) Ombudsman;

(c) Data Protection Commissioner, Data Protection Commission;

(d) Director of Public Prosecutions;
