PUBLIC SERVICE SUPERANNUATION (AMENDMENT) ACT 2018


An Act to amend the Public Service Superannuation (Miscellaneous Provisions) Act 2004 ; and to provide for related matters.

Be it enacted by the Oireachtas as follows:

Amendment of section 4 of Public Service Superannuation (Miscellaneous Provisions) Act 2004

1. Section 4 of the Public Service Superannuation (Miscellaneous Provisions) Act 2004 is amended by the addition of the following subsections:

“(4) Nothing in this section shall prevent the appointment, in accordance with the Garda Síochána Act 2005 , of a person who has attained the age of 55 years but is under the age of 60 years as a new entrant to the Garda Síochána to the rank of Commissioner of the Garda Síochána or of Deputy Garda Commissioner.

(5) Where an appointment of a person mentioned in subsection (4) is made, then—

(a) subsections (1)(b), (2) and (3) shall apply to the person if the appointment is to the rank of Commissioner of the Garda Síochána, and

(b) subsections (1)(b) and (2) shall apply to the person if the appointment is to the rank of Deputy Garda Commissioner.”.

Short title, collective citation and commencement

2. (1) This Act may be cited as the Public Service Superannuation (Amendment) Act 2018.

(2) The Public Service Superannuation (Miscellaneous Provisions) Act 2004 and this Act may be cited together as the Public Service Superannuation (Miscellaneous Provisions) Acts 2004 and 2018.

(3) This Act shall come into operation on such day or days as the Minister for Public Expenditure and Reform may by order or orders appoint either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes or different provisions.
