S.I. No. 597/2017 - Water Services Act 2007 (Threshold Amount and Allowance Amount) Order 2017

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 29th December, 2017.

I, EOGHAN MURPHY, Minister for Housing, Planning and Local Government, in the exercise of the powers conferred on me by Sections 18(1) and 53B(1) (as inserted by Section 9 of the Water Services Act 2017 (No. 29 of 2017)) of the Water Services Act 2007 (No. 30 of 2007) hereby order as follows:

1. This Order may be cited as the Water Services Act 2007 (Threshold Amount and Allowance Amount) Order 2017.

2. The threshold amount referred to under Section 53B(1)(a) (as inserted by Section 9 of the Water Services Act 2017 ) of the Water Services Act 2007 is specified as 213,000 litres per year.

3. The allowance amount referred to under Section 53B(1)(b) (as inserted by Section 9 of the Water Services Act 2017 ) of the Water Services Act 2007 is specified as 25,000 litres per year.

4. This Order shall have effect on and from 1 January 2018.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

This Order specifies the threshold and allowance amounts referred to under Section 53B(1) of the Water Services Act 2007 (as inserted by Section 9 of the Water Services Act 2017 ) below which Irish Water shall provide water services without charge to a domestic customer.

The threshold and allowance amounts are set with reference to the Review of Demand for Water Services furnished to the Minister by the Commission for Regulation of Utilities under Section 53A of the Water Services Act 2007 (as inserted by Section 8 of the Water Services Act 2017 ). A dwelling with water usage above the ‘threshold amount’ — now specified as 213,000 litres per year — may be regarded as one with excessive water usage, unless such usage is otherwise permitted under the Water Services Acts 2007 to 2017.

Dwellings having more than 4 residents are given an additional ‘allowance amount’ of 25,000 litres per year, above the threshold amount, for every person beyond 4 persons ordinarily resident in the dwelling.
