S.I. No. 556/2017 - Pyrite Resolution (standard for testing) Regulations 2017

I, DAMIEN ENGLISH, Minister of State at the Department of Housing, Planning and Local Government, in exercise of the powers conferred on me by section 5 of the Pyrite Resolution Act 2013 (No. 51 of 2013) (as adapted by the Environment, Community and Local Government (Alteration of Name of Department and Title of Minister) Order 2017 ( S.I. No. 358 of 2017 )), which powers are delegated to me by the Housing, Planning, Community and Local Government (Delegation of Ministerial Functions) (No. 2) Order 2017 ( S.I. No. 352 of 2017 ) and following consultation with the Pyrite Resolution Board hereby make the following regulations:

Citation

1. These Regulations may be cited as the Pyrite Resolution (standard for testing) Regulations 2017.

Commencement

2. These Regulations come into operation on 15 December 2017.

Interpretation Generally

3. In these Regulations:

“Act” means the Pyrite Resolution Act 2013 (No. 51 of 2013).

Standard for Testing

4. For the purpose of giving further effect pursuant to section 14(9) (a) of the Act, the “standard for testing” for the purpose of the Act shall be Irish Standard 398-1:2017 Reactive pyrite in sub-floor hardcore material — Part 1: Testing and categorisation protocol, as published by the National Standards Authority of Ireland on 4 August 2017.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations provide that pursuant to section 14 (9) (a) of the Pyrite Resolution Act 2013 , the “standard for testing” for the purpose of the Act shall be Irish Standard 398-1:2017 Reactive pyrite in sub-floor hardcore material — Part 1: Testing and categorisation protocol, as published by the National Standards Authority of Ireland on 4 August 2017.

The operative date of these Regulations is 15 December 2017.
