S.I. No. 274/2017 - Pharmaceutical Society of Ireland (Receiving and Recording of Evidence by Committee of Inquiry) Rules 2017.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th July, 2017.

The Council of the Pharmaceutical Society of Ireland, in exercise of the powers conferred on the said Society by sections 11 and 43 (4) of the Pharmacy Act 2007 (No. 20 of 2007) (as adapted by the Health and Children (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 219 of 2011 )), with the consent of the Minister for Health, hereby makes the following rules:-

1. These Rules may be cited as the Pharmaceutical Society of Ireland (Receiving and Recording of Evidence by Committee of Inquiry) Rules 2017.

2. These Rules shall come into operation on 31 May 2017.

3. A committee of inquiry may receive evidence by means of live-video link or any other mode of transmission which allows the evidence of a witness to be received clearly and in real time from a location other than that in which the hearing of the committee of inquiry is taking place.

4. Where a committee of inquiry proposes to receive evidence in a manner provided for in rule 3, it shall hear any submission as to the appropriateness of such receipt of evidence from—

(a) the registered pharmacist,

(b) the pharmacy owner or, as the case may be, the representative of that owner, or

(c) the registrar,

as applicable, and the committee of inquiry shall make a ruling on each such submission.

5. Any expenses incurred in respect of evidence called pursuant to these Rules by or on behalf of a registered pharmacist or pharmacy owner or, as the case may be, the representative of that owner, the subject of an inquiry by a committee of inquiry, shall be the responsibility of that registered pharmacist or pharmacy owner or, as the case may be, the representative of that owner.
