I, SHANE ROSS, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Commission Implementing Regulation (EU) 2017/1 of 3 January 20171 , hereby make the following regulations:

Citation

1. These Regulations may be cited as the European Union (Recreational Craft and Personal Watercraft) (Procedures for Watercraft Identification) Regulations 2017.

Amendment of European Union (Recreational Craft and Personal Watercraft) Regulations 2017

2. The European Union (Recreational Craft and Personal Watercraft) Regulations 2017 ( S.I. No. 65 of 2017 ) are amended—

(a) in Regulation 2—

(i) in paragraph (1), by the insertion of the following:

(I) “ ‘Commission Implementing Regulation’ means Commission Implementing Regulation (EU) 2017/1 of 3 January 2017 on procedures for watercraft identification under Directive 2013/53/EU of the European Parliament and of the Council of 20 November 2013 on recreational craft and personal watercraft1;”, and

(II)“ ‘national body’ means the Marine Survey Office;”,

and

(ii) by the substitution of the following paragraph for paragraph (2):

“(2) A word or expression which is used in these Regulations and which is also used in the Directive or in the Commission Implementing Regulation has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Directive or in the Commission Implementing Regulation, as the case may be.”,

and

(b) by the insertion of the following after Part 4:

“Part 4A

Procedures for Watercraft Identification

National body

25A. (1) The Marine Survey Office is designated as the national body in the State responsible for assigning the unique code of the manufacturer in accordance with the Commission Implementing Regulation.

(2) For the purposes of Articles 6 and 7 of the Commission Implementing Regulation, the language referred to in those Articles shall be the Irish or English language.”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations give effect to Commission Implementing Regulation (EU) 2017/1 of 3 January 2017 which lays down minimum rules regarding the procedure for the assignment and administration of the unique code of the manufacturer, for watercraft identification purposes, under Directive 2013/53/EU of the European Parliament and of the Council on recreational craft and personal watercraft.

The Marine Survey Office is designated as the national body in Ireland responsible for assigning the unique code of the manufacturer.
