S.I. No. 127/2017 - Companies Act 2014 (Section 1313) Regulations 2017.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th April, 2017.

I, MARY MITCHELL O’CONNOR, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 1313 (1) of the Companies Act 2014 (No. 38 of 2014) and having complied with subsection (2) of that section, hereby make the following Regulations:

1. These Regulations may be cited as the Companies Act 2014 (Section 1313) Regulations 2017.

2. In these Regulations—

“Act of 2014” means the Companies Act 2014 (No. 38 of 2014).

3. The following provisions of the Companies Act 2014 are added, but only in respect of a body referred to in section 1312 of the Act that is a traded body within the meaning of subsection (5) and (6) of that section, to the list of provisions specified in Schedule 14 to the Act of 2014:

(a) Sections 4 and 5;

(b) Sections 35 and 36;

(c) Sections 41 and 48;

(d) Section 64;

(e) Section 83;

(f) Chapters 1 and 2 of Part 5;

(g) Chapters 1 and 2 of Part 9;

(h) Chapter 9 of Part 17;

(i) Section 1116;

(j) Section 1374;

(k) Section 1429;

(l) Section 1440.

EXPLANATORY NOTE

The purpose of these Regulations is to apply various sections of the Companies Act 2014 to any unregistered company in Part 22 of the Act that is a “traded body”.
