S.I. No. 485/2016 - Credit Reporting Act 2013 (Section 6) (Additional Personal Information) Regulations 2016.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 23rd September, 2016.

In exercise of the powers conferred on it by section 6 (4) of the Credit Reporting Act 2013 (No. 45 of 2013), the Central Bank of Ireland, considering that the holding on the Central Credit Register of the personal information specified in the following regulations is likely to facilitate the accurate identification of credit information subjects, following consultation with the Data Protection Commissioner and with the consent of the Minister for Finance, hereby makes the following regulations:

Citation and Commencement

1. (1) These Regulations may be cited as the Credit Reporting Act 2013 (Section 6) (Additional Personal Information) Regulations 2016.

(2) These Regulations come into operation on 30 June 2017.

Interpretation

2. (1) In these Regulations:

“Act of 2013” means the Credit Reporting Act 2013 (No. 45 of 2013);

“Bank” means the Central Bank of Ireland.

(2) A word or expression used in these Regulations has the same meaning in these Regulations as it has in the Act of 2013.

Additional Personal Information

3. (1) The following additional information is hereby specified to be personal information in relation to a credit information subject who is an individual:

(a) the individual’s gender;

(b) any indicator denoting that the individual is deceased.

(2) The following additional information is hereby specified to be personal information in relation to a credit information subject who is an individual carrying on activities otherwise than as an employee:

(a) all reference numbers allocated to the credit information subject for the purposes of tax (whether in the State or any other country or territory);

(b) any registration number issued to the credit information subject by an authority in any other country or territory in the exercise of a function similar to the function exercised by the Companies Registration Office.

(3) The following additional information is hereby specified to be personal information in relation to a credit information subject which is not an individual:

(a) the Legal Entity Identifier (LEI) in respect of the credit information subject, within the meaning of the Charter of the Regulatory Oversight Committee for the Global Legal Entity Identifier (LEI) System, done on the 5th November 2012;

(b) any registration number issued to the credit information subject by an authority in any other country or territory in the exercise of a function similar to the function exercised by the Companies Registration Office.

The Minister for Finance consents to the making of these Regulations.
