S.I. No. 503/2015 - Garda Síochána (Discipline) (Amendment) Regulations 2015.

“Iris Oifigiúil” of 13th November, 2015.

I, FRANCES FITZGERALD, Minister for Justice and Equality, in exercise of the powers conferred on me by section 123 of the Garda Síochána Act 2005 (No. 20 of 2005) (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 138 of 2011 )), after consulting with the Commissioner of the Garda Síochána and with the approval of the Government, hereby make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Discipline) (Amendment) Regulations 2015.

2. The Garda Síochána (Discipline) Regulations 2007 ( S.I. No. 214 of 2007 ) (as amended by the Garda Síochána (Discipline) (Amendment) Regulations 2011 ( S.I. No. 620 of 2011 )) are amended—

(a) in Regulation 3(1)—

(i) by the insertion of the following definitions:

“ ‘Chief Administrative Officer’ means the member of the civilian staff of the Garda Síochána who holds the position of Chief Administrative Officer in the Garda Síochána;

‘Executive Director, Human Resources and People Development’ means the member of the civilian staff of the Garda Síochána who holds the position of Executive Director, Human Resources and People Development in the Garda Síochána;”, and

(ii) in the definition of “Commissioner”—

(I) at the end of paragraph (b), by the deletion of “or”,

(II) in paragraph (c), by the substitution of “that have been duly delegated to him or her, ” for “that have been duly delegated to him or her.”, and

(III) by the addition of the following paragraphs after paragraph (c):

“(d) the Chief Administrative Officer when performing any of the Commissioner’s functions under these regulations that have been duly delegated to him or her, or

(e) the Executive Director, Human Resources and People Development when performing any of the Commissioner’s functions under these regulations that have been duly delegated to him or her;”,

(b) in Regulation 6(1), by the insertion of “or to the Chief Administrative Officer or to the Executive Director, Human Resources and People Development” after “chief superintendent”, and

(c) in Regulation 14, by substituting the following paragraph for paragraph (2):

“(2) The appointment shall be made by—

(a) a member who is not below the rank of chief superintendent,

(b) the Chief Administrative Officer, or

(c) the Executive Director, Human Resources and People Development,

(in these regulations referred to as an ‘appointing officer’).”.

The Government hereby approve of the making of the foregoing Regulations.
