S.I. No. 30/2014 - Security Industry Joint Labour Committee Establishment (Amendment) Order 2014.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 31st January, 2014.

WHEREAS I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, being in receipt of a copy of a recommendation under subsection (5) of section 41A (inserted by section 11 of the Industrial Relations (Amendment) Act 2012 (No. 32 of 2012)) of the Industrial Relations Act 1946 (No. 26 of 1946) and being satisfied that subsection (3) of section 41A has been complied with and considering it appropriate to do so:

NOW, I, RICHARD BRUTON, in exercise of the powers conferred on me by subsection (6) of section 41A (inserted by section 11 of the Industrial Relations (Amendment) Act 2012 (No. 32 of 2012)) of the Industrial Relations Act 1946 (No. 26 of 1946) (as adapted by the Enterprise, Trade and Innovation (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 245 of 2011 )) hereby order as follows:

1. This Order may be cited as the Security Industry Joint Labour Committee Establishment (Amendment) Order 2014.

2. The Schedule to the Security Industry Joint Labour Committee Establishment Order 1998 ( S.I. No. 377 of 1998 ) is amended by—

(a) substituting the following paragraphs for the paragraph entitled “Workers to whom this Schedule applies”:

Workers to whom this Schedule applies

Security operatives.

Meaning of ‘security firm’

‘security firm’ means an employer who employs one or more security operatives.

Meaning of ‘security operative’

‘security operative’ means a person employed by a security firm to—

(i) provide a security service for contract clients of that firm, and

(ii) perform one or more of the primary functions set out below.”, and

(b) inserting the following subparagraph after subparagraph (iii) in the paragraph entitled “Primary functions of security operatives”:

“(iv) The protection of individuals from bodily harm.”.
