I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 36 of the Animal Health and Welfare Act 2013 (No. 15 of 2013), hereby make the following regulations:

1. These Regulations may be cited as the Control On Places Where Horses Are Kept Regulations 2014 and come into operation on 6 March 2014.

2. In these Regulations—

“Act” means Animal Health and Welfare Act 2013;

“Minister” means Minister for Agriculture, Food and the Marine;

“keeper” means a person who has custody of a horse whether on a temporary or permanent basis;

3. (1) A person shall not—

(a) keep a horse,

(b) sell a horse, or

(c) operate a sporting or cultural event involving horses,

unless the land or premises where the horse is kept, including the land or premises where the sale or cultural event takes place is entered in the register maintained under this Regulation (“register”).

(2) The Minister may maintain the register, enter the name and address of a person and the name and address of land or premises where a horse is kept in the register, attach conditions to registration, suspend or revoke registration or refuse an application.

(3) An application for registration shall be in a form and contain any information that the Minister may require and may be made electronically in accordance with the directions of the Minister.

(4) The Minister shall not consider an application unless the application contains all the information sought by the Minister.

(5) A person whose name is entered in the register shall make such returns to the Minister as the Minister may require.

(6) If a person ceases to keep horses on land or premises he or she shall inform the Minister who shall amend the register accordingly.

4. The owner or person in charge of a premises entered on the register shall maintain such records of the movement of a horse to and from the premises as the Minister may from time to time require.

5. A person who organises a sale of horses or a sporting or cultural event at which horses are present shall maintain a record of-

(a) the identity of each horse present,

(b) the date the horse is at the sale or sporting or cultural event, and

(c) the name, address and premises registration number of the owner or keeper who presents the equine at the sale or sporting or cultural event and in cases where horses are purchased on the land or premises, the name and address of the owner or keeper who purchases an equine.

6. A record maintained under Regulation 4 or 5 shall be maintained for 2 years and made available for inspection on demand by an authorised officer.

7. Registration under the Diseases of Animal Act 1966 (Registration of Horse Premises) Order 2012 that was in effect immediately before the commencement of the Act, continues to have effect and may be dealt with as if it were registration under these Regulations.

8. Regulation 3(1) is a penal provision to which section 36 (4) (b) of the Act applies.

9. Regulations 3(5), (6), 5 and 6 are penal provisions to which section 36 (4) (a) of the Act applies
