S.I. No. 220/2013 - Local Government Management Agency (Establishment) (Amendment) Order 2013.

I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 3 (as amended by section 5 of the Local Government (Miscellaneous Provisions) Act 2012 (No. 17 of 2012)), of the Local Government Services (Corporate Bodies) Act 1971 (No. 6 of 1971) (as adapted by the Environment, Heritage and Local Government (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 193 of 2011 )), hereby order as follows:

Citation

1. This Order may be cited as the Local Government Management Agency (Establishment) (Amendment) Order 2013.

2. The Principal Order and this Order may be cited together as the Local Government Management Agency (Establishment) Orders 2012 and 2013 and shall be construed as one.

Commencement

3. This Order shall come into operation on 1st July, 2013.

Definitions

4. In this Order—

“Director of Audit” means the Director of Audit of the Local Government Audit Service as defined by Section 116 of the Local Government Act 2001 (No. 37 of 2001);

“Principal Order” means the Local Government Management Agency (Establishment) Order 2012 ( S.I No. 290 of 2012 ).

Amendments to the Principal Order

5. Article 5 of the Principal Order is amended by inserting the following new subparagraph after subparagraph (b):

“(c) Section 3 subsection (9) (a), (b), (c), (d), (e), (f), (g), (i), (j) and (k) of The Local Government Services (Corporate Bodies) Act 1971 as inserted by Section 5(c) of the Local Government (Miscellaneous Provisions) Act 2012 .”.

6. Article 6 of the Principal Order is amended as follows:

by substituting for paragraph 1 the following paragraph,

“(1) Not less than six and not more than eight members of the Local Government Management Agency shall be appointed by the Council and not less than one and not more than four members shall be appointed by the Minister.”;

by inserting the following after subparagraph (3)(b),

“ and

(c) one person, with relevant expertise in the services delivered by the Agency, as the Minister may appoint from time to time.”;

by substituting for paragraph 6 the following paragraph,

“(6) The Board shall appoint from among its members a Chairperson, to be known as the Board Chairperson, who shall hold office for not less than two years and not more than three years unless sooner ceasing to be a member of the Board.”;

and,

by substituting for subparagraph (18)(c) the following subparagraph,

“(c) A statement of accounts of the Agency for each financial year shall, as soon as may be after the end of such financial year, be prepared and after such preparation be audited by and be subject to a report by an auditor appointed by the Director of Audit after consultation with the Agency,”.
