S.I. No. 144/2013 - Burial Ground (Amendment) Regulations, 2013.

I, PHIL HOGAN, Minister for the Environment, Community and Local Government in exercise of the powers conferred on me by section 181 of the Public Health (Ireland) Act 1878 and section 1 (iv) of the Ministers and Secretaries Act 1924 (No.16 of 1924) (as adapted by the Environment, Heritage and Local Government (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 193 of 2011 )) hereby make the following regulations:

Citation

1. These regulations may be cited as the Burial Ground (Amendment) Regulations, 2013.

Commencement

2. These regulations shall come into operation on the 1st day of June, 2013.

Interpretation

3. In these regulations “the Principal Regulations” means the Rules and Regulations for the Regulation of Burial Grounds, &c, Dated 6th July, 1888.

4. The Principal Regulations are amended by substituting for Rule No. V the following:

V.

(i) Subject to (ii), no interment shall be permitted in any burial ground, nor shall any dead body be admitted into any place of reception of bodies previous to interment, unless the body be enclosed in a coffin of wood or some other sufficiently strong material. Any person presenting a body for interment in violation of this rule shall be liable to a penalty of €125.

(ii) Uncoffined burials may be permitted, unless a direction has been issued not to do so by the relevant sanitary authority or medical officer of health of the sanitary authority, in an area of a burial ground designated exclusively for that purpose. Where an uncoffined burial is permitted, any reference in these provisions to a coffin includes a reference to the wrappings of the uncoffined body.”
