S.I. No. 124/2013 - Statistics (Waste Generation) Order 2013.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 16th April, 2013.

I, ENDA KENNY, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No.21 of 1993), hereby order as follows:

1. This Order may be cited as the Statistics (Waste Generation) Order 2013.

2. In this Order—

“Act” means the Statistics Act 1993 (No. 21 of 1993);

“Commission Regulation” means Commission Regulation (EC) No.2150/2002 of 25 November 2002 1 as amended by Commission Regulation (EU) No. 849/2010 of 27 September 20102;

“forms and questionnaires” means the forms and questionnaires referred to in Article 8 (a);

“survey” means the Waste Generation Survey 2012 which is conducted by the Central Statistics Office and is required by the Commission Regulation.

3. A word or expression used in this Order and which is also used in the Commission Regulation has the same meaning as in that Regulation except where the context otherwise requires.

4. The purpose of this Order also includes giving further effect to the Commission Regulation.

5. The survey shall be known and referred to as the Waste Generation Survey 2012.

6. This Order applies to an undertaking that is required by the Central Statistics Office to participate in the survey and that is classified for statistical purposes under any sections of NACE Rev.2 set out in Annex 1 to Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 20063.

7. Each undertaking to which this Order applies is required to provide information to the Central Statistics Office for the purposes of the survey, the general nature of which is specified in the Schedule.

8. An undertaking required by this Order to provide information to the Central Statistic Office shall provide such information—

(a) By the completion of forms and questionnaires prepared by the Director General in accordance with section 23 of the Act, and

(b) Where directions under section 26 of the Act have been given to the undertaking, in accordance with those directions.

SCHEDULE

Information in relation to the year 2012 regarding each of the following:

1. General information on the business activity

2. Brief description of company activities

3. European Waste Catalogue Code for each type of waste

4. Particulars on whether the waste is hazardous

5. Description of the waste

6. Quantity of the waste

7. Particulars on whether waste is a process waste

8. Location where the waste was treated

9. Name and address of waste operator who collected the waste

10. Licence or permit number of waste operator

11. On-site waste treatment operations

EXPLANATORY NOTE

The purpose of this Order is to enforce a statutory collection of statistical information on waste which will contribute to the availability of comparable, reliable, synchronised, and comprehensive data at European level.
