S.I. No. 112/2012 - Property Services (Regulation) Act 2011 (Commencement) Order 2012.


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 10th April, 2012.

I, ALAN SHATTER, Minister for Justice and Equality, in exercise of the powers conferred on me by section 1 (2) of the Property Services (Regulation) Act 2011 (No. 40 of 2011), hereby order as follows:

1. This Order may be cited as the Property Services (Regulation) Act 2011 (Commencement) Order 2012.

2. The 3rd day of April 2012 is appointed as the day on which the following provisions of the Property Services (Regulation) Act 2011 (No. 40 of 2011) shall come into operation:

(a) sections 1 and 2;

(b) sections 5 and 6;

(c) Part 2;

(d) Part 12;

(e) sections 95 to 97;

(f) section 101 in so far as it relates to paragraphs 9 and 10 of Schedule 8;

(g) paragraphs 9 and 10 of Schedule 8.

EXPLANATORY NOTE

This Order appoints 3 April, 2012 as the date on which the provisions of sections 1 and 2, sections 5 and 6, Part 2, Part 12, sections 95 to 97, section 101 in so far as it relates to paragraphs 9 and 10 of Schedule 8 and paragraphs 9 and 10 of Schedule 8 of the Property Services (Regulation) Act 2011 come into operation.

This Order provides for the establishment of the Property Services Regulatory Authority on 3 April, 2012. It will enable the Authority to commence work on maintaining and publishing residential property sales prices as well as establishing and maintaining a Commercial Leases Database. The Order will also permit the Authority to commence its preparations for the future licensing system for auctioneers, letting agents and property management agents.
