S.I. No. 308/2011 - Environmental Protection Agency Act 1992 (First Schedule) (Amendment) Regulations 2011.

I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 3B (inserted by section 5 of the Protection of the Environment Act 2003 (No. 27 of 2003)) of the Environmental Protection Agency Act 1992 (No. 7 of 1992) (as adapted by the Environment, Heritage and Local Government (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 193 of 2011 )) and for the purpose of giving effect to Article 37 of Directive 2009/31/EC of the European Parliament and of the Council of 23 April 20091 on the geological storage of carbon dioxide, hereby make the following regulations:

1. These Regulations may be cited as the Environmental Protection Agency Act 1992 (First Schedule) (Amendment) Regulations 2011.

2. The Environmental Protection Agency Acts 1992 to 2007 and these Regulations may be cited together as the Environmental Protection Agency Acts 1992 to 2011.

3. The Environmental Protection Agency Act 1992 (No. 7 of 1992) is amended in the First Schedule (inserted by section 18 of the Protection of the Environment Act 2003 (No. 27 of 2003)) by inserting the following paragraph after paragraph 13.4.2:

“13.5 The capture of CO2 streams from installations to which Part IV applies for the purposes of geological storage pursuant to Directive 2009/31/EC of the European Parliament and of the Council of 23 April 20091 on the geological storage of carbon dioxide.”

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations transpose Article 37 of Directive 2009/31/EC of the European Parliament and of the Council of 23 April 2009 on the geological storage of carbon dioxide and the amendments arising in relation to Council Directive 2008/1/EC concerning integrated pollution prevention and control.

This requires that Directive 2008/1/EC of the European Parliament and of the Council of 15 January 2008 concerning integrated pollution prevention and control2 should be applied to the capture of carbon dioxides streams for the purpose of geological storage from installations covered by that Directive.
