S.I. No. 53/2008 - Limerick City Boundary Alteration Order 2008


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 7th March, 2008.

WHEREAS I, John Gormley, Minister for the Environment, Heritage and Local Government, established a Boundary Committee (“the Committee”) pursuant to Sections 28 (1) and 33 of the Local Government Act 1991 (No.11 of 1991) (hereafter referred to as “the Act”) and requested it to prepare a report under Section 33 of the Act with respect to the boundary of Limerick City.

AND WHEREAS pursuant to Section 33 of the Act the Committee reviewed the said boundary and made such recommendations with respect to the boundary that it considered necessary in the interests of effective and convenient local government.

AND WHEREAS further pursuant to Section 33 of the Act the Committee prepared and furnished to me a report in writing of its review and recommendations.

AND WHEREAS having regard to the said report I consider that an alteration ought to be made to the boundary of Limerick City in the interests of effective and convenient local government.

NOW THEREFORE, I, John Gormley, Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on me by Sections 3 and 31 (3) of the Local Government Act 1991 (No. 11 of 1991) (as adapted by the Environment and Local Government (Alteration of Name of Department and Title of Minister) Order 2003 ( S.I. No. 233 of 2003 )) hereby make the following order with respect to which, pursuant to Section 3(6) of that Act, a draft has been laid before each House of the Oireachtas and a resolution approving of the draft has been passed by each such House:

1. This Order may be cited as the Limerick City Boundary Alteration Order 2008.

2. This Order shall come into operation on 1 March 2008.

3. The areas shown as “relevant areas” on the map attached to this Order titled “Limerick City (1)” and date stamped 11 February 2008 shall be detached from Limerick County and from the jurisdiction and the powers of Limerick County Council, and shall be added to Limerick City and thenceforward the relevant areas shall be included in and form part of Limerick City for all purposes.

4. The boundary of Limerick City shall thenceforward be as shown on the map attached to this Order titled “Limerick City (2)” and date stamped 11 February 2008.

5. The boundary of Limerick County shall thenceforward be as shown on the map attached to this Order titled “Limerick County” and date stamped 11 February 2008.

This Order extends the boundary of Limerick City from 1 March 2008. It should be read together with a separate Order, the Limerick City Boundary Alteration (Supplementary) Order 2008 ( S.I. No. 54 of 2008 ) which contains supplementary provisions related to the boundary extension.
