EUROPEAN COMMUNITIES (CONSUMER INFORMATION ON FUEL ECONOMY AND CO2 EMISSIONS OF NEW PASSENGER CARS) (AMENDMENT) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 4th July, 2008.

The Minister for the Environment, Heritage and Local Government, in exercise of the powers conferred on him by Section 3 of the European Communities Acts 1972 to 1997 and for the purposes of giving effect to the provisions of Council Directive 1999/94/EC 1 , as amended by Commission Directive 2003/73/EC 2 , relating to the availability of consumer information on fuel economy and CO2 emissions in respect of the marketing of new passenger cars, hereby makes the following Regulations:—

PART I PRELIMINARY AND GENERAL

Citation

1. (1) These Regulations may be cited as the European Communities (Consumer Information on Fuel Economy and CO2 Emissions of New Passenger Cars) (Amendment) Regulations 2008.

(2) These Regulations and the European Communities (Consumer Information on Fuel Economy and CO2 Emissions of New Passenger Cars) Regulations 2001 ( S.I. No. 339 of 2001 ) shall be construed together as one and may be collectively cited as the European Communities (Consumer Information on Fuel Economy and CO2 Emissions of New Passenger Cars) Regulations 2001 to 2008.

Entry into Force

2. These Regulations shall come into force on the 1st day of July 2008.

Interpretation

3. In these Regulations, “the 2001 Regulations” mean the European Communities (Consumer Information on Fuel Economy and CO2 Emissions of New Passenger Cars) Regulations 2001 ( S.I. No. 339 of 2001 ).

PART II AMENDMENT OF THE 2001 REGULATIONS

Amendment of Article 3

4. The following is substituted for “the Directive”:

“ “the Directive” means Council Directive 1999/94/EC of 13 December 1999, as amended by Commission Directive 2003/73/EC, relating to the availability of consumer information on fuel economy and CO2 emissions in respect of the marketing of new passenger cars.”.

Amendment of Article 5

5. The following is substituted for Article 5(1):

“(1) A distributor shall ensure that a label, in accordance with the format and containing the information specified in Annex I to the Directive, is attached to, or displayed near, in a clearly visible manner, each new model at a point of sale.”.

Amendment of Article 7

6. The following is substituted for Article 7(3):

“(3) The poster shall be in accordance with the format and contain the information and data specified in Annex III to the Directive, as amended.”.

Amendment of the Schedule

7. The Schedule is deleted.
