EUROPEAN COMMUNITIES (QUALITY AND SAFETY OF HUMAN BLOOD AND BLOOD COMPONENTS) (AMENDMENT) REGULATIONS 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 13th June, 2008.

I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the European Communities Act l972 (No. 27 of l972) (as amended by the European Communities (Amendment) Act 2007 (No. 18 of 2007)) and for the purpose of giving further effect to Directive 2002/98/EC of the European Parliament and of the Council of 27 January 2003 1 hereby make the following regulations:

1. These regulations may be cited as the European Communities (Quality and Safety of Human Blood and Blood Components) (Amendment) Regulations 2008.

2. Regulation 2 (1) of the European Communities (Quality and Safety of Human Blood and Blood Components) Regulations 2005 ( S.I. No. 360 of 2005 ) is amended by the substitution of the following for the definition of “qualified health professional”:

“ ‘qualified health professional’ means—

(a) a registered medical practitioner within the meaning of—

(i) the Medical Practitioners Act 1978 (No. 4 of 1978), or

(ii) the Medical Practitioners Act 2007 (No. 25 of 2007),

(b) a nurse whose name is entered in the register of nurses maintained under section 27 of the Nurses Act 1985 (No. 18 of 1985), or

(c) a person who has successfully completed a training course approved by a blood establishment which has established the competency of that person to assess the eligibility of a donor to donate blood.”.

These Regulations are made under section 3 of the European Communities Act l972 (No. 27 of l972) (as amended by the European Communities (Amendment) Act 2007 (No. 18 of 2007)).

The Regulations amend Article 2(1) of the European Communities (Quality and Safety of Human Blood and Blood Components) Regulations 2005 ( S.I. No. 360 of 2005 ) by the insertion of part (c) under the definition of “qualified health professional”. This amendment allows for “a person, who has successfully completed a training course approved by a blood establishment, which established the competency of that person to assess the eligibility of donors to donate” to be included under the definition of “qualified health professional”.

These Regulations may be cited as the European Communities (Quality and Safety of Human Blood and Blood Components) (Amendment) Regulations 2008.
