ROAD TRAFFIC (LICENSING OF LEARNER DRIVERS) (CERTIFICATES OF COMPETENCY) REGULATIONS 2007

I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 42(3)(n) (inserted by section 10 of the Road Traffic Act 2006 (No. 23 of 2006)) of the Road Traffic Act 1961 (No. 24 of 1961) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 ), hereby make the following regulations:

1. (1) These Regulations may be cited as the Road Traffic (Licensing of Learner Drivers) (Certificates of Competency) Regulations 2007.

(2) These Regulations come into operation on 30 October 2007.

2. A person who after the commencement of these Regulations is granted a learner permit for a vehicle in category A, A1, M, W, B or EB by a licensing authority and has not previously held, within the period of 5 years prior to the granting, such a permit in that category, is not entitled to make an application for a certificate of competency to an issuing authority within the period of 6 months from the day the permit comes into force.

These regulations provide that a person who is granted a learner permit for a vehicle in category A, A1, M, W, B or EB by a licensing authority and has not previously held, within the period of 5 years prior to the granting, such a permit in that category, is not entitled to make an application to an issuing authority for a certificate of competency within the period of 6 months from the day the permit comes into force.
