STATISTICS (ROAD FREIGHT) ORDER 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th October, 2007.

I, BERTIE AHERN, Taoiseach, in exercise of the powers conferred on me by section 25(1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving further effect to Council Regulation (EC) No. 1172/98 of 25 May 1998 1 , hereby order as follows:

1. (1) This Order may be cited as the Statistics (Road Freight) Order 2007.

(2) This Order comes into operation on 30 September 2007.

2. In this Order—

“goods road transport vehicle” has the same meaning as it has in Article 2 of Council Regulation (EC) No. 1172/98 of 25 May 1998 1 ;

“registered” means entered in the register of vehicles established under section 131 of the Finance Act 1992 (No. 9 of 1992).

3. This Order applies to a person or undertaking that uses a goods road transport vehicle that is registered.

4. A person or undertaking to whom this Order applies is prescribed as a person or undertaking required to provide the Office with information, the general nature of which information is specified in the Schedule, relating to each goods road transport vehicle (“vehicle”) used by the person or undertaking concerned.

5. Information, the general nature of which is specified in the Schedule, is prescribed as information required to be provided for the purposes of surveys of persons to whom and undertakings to which this Order applies.

6. The information referred to in Article 5 shall be provided weekly, monthly, quarterly, half yearly or annually, as requested by the Director General.

7. (1) Subject to paragraph (2), a person or undertaking required by this Order to provide information to the Office shall provide such information by the completion of forms and questionnaires prepared by the Director General in accordance with section 23 of the Statistics Act 1993 (No. 21 of 1993).

(2) A person or undertaking required by this Order to furnish information shall be deemed to comply with that obligation where, with the consent of the Director General, the information is furnished by electronic means, and provided that the Director General approves the format or manner in which the information is provided.

SCHEDULE

Particulars of the—

1. age of the vehicle, the latest change of ownership (if any) of the vehicle and confirmation as to whether the vehicle has been scrapped,

2. business of the person or undertaking concerned,

3. use to which the vehicle was put during the period to which the survey relates,

4. carrying capacity of the vehicle,

5. weight and capacity of any trailer which has been attached to the vehicle during the period to which the survey relates,

6. type of body of the vehicle,

7. use to which the vehicle is normally put,

8. positions of the axles on the vehicle, and

9. odometer readings in miles or kilometres of the vehicle at the beginning and end of the period to which the survey relates.

The purpose of this order is to enforce a statutory collection of statistical information on the scale and development of the carriage of goods by road by means of vehicles registered in the Republic of Ireland which will contribute to the availability of comparable, reliable, synchronized and comprehensive data at European level.
