TELECOMMUNICATIONS TARIFF REGULATION (REVOCATION) ORDER, 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 5th October, 2007.

I, MIKE BYRNE, Chairperson of the Commission for Communications Regulation, in exercise of the powers conferred on me by section 7 (2) of the Telecommunications (Miscellaneous Provisions) Act 1996 (No. 34 of 1996), hereby order as follows:

1. (1) This Order may be cited as the Telecommunications Tariff Regulation (Revocation) Order, 2007.

(2) This Order, subject to Article 4, comes into operation on the 1st day of October 2007

2. In this Order—

“the Order of 2003” means the Telecommunications Tariff Regulation Order 2003 ( S.I. No. 31 of 2003 );

3. Subject to Article 4, the Order of 2003 is revoked.

4. Notwithstanding Article 3, if an appeal is lodged under the European Communities (Electronic Communications Networks and Services) (Framework) Regulations 2003 in respect of the decision entitled “Decision Notice and Decision Instrument — SMP Obligations: Retail Price Cap Remedy”, dated the 1st of October, 2007 and made by the Commission for Communications Regulation, the Order of 2003 shall continue in full force and this Order shall not come into operation.
