COPYRIGHT AND RELATED RIGHTS ACT 2000 (CERTAIN PROVISIONS) (COMMENCEMENT) ORDER 2007

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 20th April, 2007.

I, MICHAEL AHERN, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 1(2) of the Copyright and Related Rights Act 2000 (No.28 of 2000) and the Enterprise, Trade and Employment (Delegation of Ministerial Functions) (No.2) Order 2003 ( S.I. No. 157 of 2003 ), hereby order as follows:

1. This Order may be cited as the Copyright and Related Rights Act 2000 (Certain Provisions) (Commencement) Order 2007.

2. (1) Subject to paragraph (2) of this Article, the 1st day of May 2007 is appointed as the day on which the Copyright and Related Rights Act 2000 (No.28 of 2000), in so far as it is not already in operation, shall come into operation.

(2) Paragraph (1) of this Article does not apply to sections 98, 199 and 247 of the Copyright and Related Rights Act 2000 .

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

This Order will appoint the day on which section 198 of the Copyright and Related Rights Act 2000 comes into operation.

The purpose of section 198 is to ensure that copies of books first made available in the State are delivered to certain libraries. The section updates the deposit scheme as set out in section 56 of the 1963 Copyright Act (repealed).
