European Communities (Passenger Car Entry into Service) (Amendment) (No 2) Regulations 2006.

I, Martin Cullen, Minister for Transport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Directive 2005/55/EC of the European Parliament and of the Council of 28 September 2005¹ and Commission Directive 2006/20/EC of 17 February 2006² in so far as they relate to the entry into service of motor vehicles, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Passenger Car Entry into Service (Amendment) (No. 2) Regulations 2006.

2. The European Communities (Passenger Car Entry into Service) Regulations 2003 ( S.I. No. 552 of 2003 ) are amended by substituting for Schedule 2 (inserted by the European Communities (Passenger Car Entry into Service) (Amendment) Regulations 2006 ( S.I. No. 165 of 2006 )) the following:

Explanatory Note

(This note is not part of the Instrument and does not purport to be a legal interpretation)

The European Communities (Passenger Car Entry into Service) Regulations 2003 ( S.I. No. 552 of 2003 ) implemented in Ireland entry into service provisions of a number of European Community Directives which deal with the type approval/entry into service of motor vehicles. The relevant EC Directives are listed in Schedule 2 to those Regulations.

Subsequent Regulations have been made amending S.I. No. 552 of 2003 , the latest being S.I. No. 165 of 2006 , by substituting a new Schedule 2 to take account of further directives subsequently adopted.

These Regulations further amend S.I. No. 552 of 2003 , as amended by S.I. No. 165 of 2006 , by substituting a new Schedule 2 to give effect in Irish law to the following additional Directives of the European Parliament and of the Council in regard to entry into service for passenger cars:

Directive 2005/55/EC (relating to emissions of gaseous and particulate pollutants)

Directive 2006/20/EC (relating to fuel tanks and rear underrun protection).
