OIL POLLUTION OF THE SEA (CIVIL LIABILITY AND COMPENSATION) (AMENDMENT) ACT 2003 (COMMENCEMENT OF CERTAIN PROVISIONS ORDER 2005.

I, PAT THE COPE GALLAGHER, Minister of State at the Department of Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 12(3)(b) of the Oil Pollution of the Sea (Civil Liability and Compensation) (Amendment) Act 2003 (No. 33 of 2003), (as adapted by the Marine and Natural Resources (Alteration of Name of Department and Title of Minister Order 2002 ( S.I. No. 307 of 2002 ), and the Marine (Delegation of Ministerial Functions) (No. 2) Order 2004 ( S.I. No. 703 of 2004 )), hereby order as follows:

1. This Order may be cited as the Oil Pollution of the Sea (Civil Liability and Compansation) (Amendment) Act 2003 (Commencement of Certain Provisions) Order 2005.

2. The 3rd day of March, 2005, is hereby appointed as the day on which the Oil Pollution of the Sea (Civil Liability and Compensation) (Amendment) Act 2003 (No. 33 of 2003), in so far as it is not already in operation, comes into operation.

EXPLANATORY NOTE.

The Oil Pollution of the Sea (Civil Liability and Compensation) (Amendment) Act 2003 amends the Oil Pollution of the Sea (Civil Liability and Compensation) Acts 1988-1998, in order to provide for compensation to be paid to victims of oil pollution from tankers to be increased in line with internationally agreed levels.

This includes certain provisions that give effect to the Protocol of 2003 to the International Convention on the establishment of an International Fund for Compensation for Oil Pollution Damage, 1992. The Protocol establishes a Supplementary Fund, which increases almost four-fold the amount of compensation available.

This Commencement Order gives effect to those provisions.
