Residential Institutions Redress Act 2002 (Additional Institutions) Order 2004


I, Mary Hanafin, Minister for Education and Science, in exercise of the powers conferred on me by section 4 of the Residential Institutions Redress Act 2002 (No. 13 of 2002), and having caused a draft to be laid before each House of the Oireachtas and a resolution approving of the draft having been passed by each such House, hereby order as follows:

1.   This Order may be cited as the Residential Institutions Redress Act 2002 (Additional Institutions) Order 2004.

2.   The Schedule to the Residential Institutions Redress Act 2002 (No. 13 of 2002) is amended by the insertion of the institutions specified in the Schedule to this Order.

i.    National Remand & Assessment Unit (formerly St. Michael's Remand & Assessment Centre), and

ii.    The Care & Education Unit (formerly St. Laurence's Industrial School)

Kilcornan Centre, Clarinbridge, Co. Galway.

Explanatory Memorandum

(This does not form part of the Statutory Instrument and does not purport to be a legal interpretation).

Section 4(1) of the Residential Institutions Redress Act 2002 allows the Minister for Education and Science to make an order to provide for the insertion in the Schedule of the Act any industrial school, reformatory school, orphanage, children's home, special school which was established for the purpose of providing education services to children with a physical or intellectual disability or a hospital providing medical or psychiatric services to people with a physical or mental disability or mental illness in which children were placed and resident and in respect of which a public body had a regulatory or inspection function.

An order under this section requires a resolution of each House of the Oireachtas to approve of the draft of the order. Dáil Éireann passed a resolution approving the draft order on 19th October 2004. Seanad Éireann passed a resolution on 20th October 2004.
